April 23 French Dip Sandwich Lettuce with Dressing Italian Vegetables Pudding M ilk A b ill that would allow a school d istrict's defeated B' ballot tax levy to be subm it ted to voters more times than presently allowed is be ing sponsored by Sen Walt Brown, D Lake Oswego Passage of SB 623 would authorize placing a B levy- on a ballot after it has been defeated twice following a successful 'A levy It is cur rently waiting for a Senate C om m ittee on E le ctio n s hearing The catch, however, is that signatures of 20 percent of persons voting in the last election held on the proposed levy must first be gather«*d on an in itia tive petition and subm itted to the school board L'nder present state law, a B ’ levy th a t has been defeated tw ice fo llo w in g passage of its corresponding A ’ levy cannot be resubm it ted to voters, not even by in itiative petition The b ill has been drafted by the Clackamas County senator in response to a situation in the Damascus Cnion School D istrict last November, when several residents gathered more than 300 signatures in an ef fo r t to r e s u r r e c t the district's B levy The d istrict's A ’ levy had passed in June, but its ’B' levy had faihxl in September and November Reacting to subsequent elim ination of school bus t r a n s p o r t a t io n , s e v e ra l D am ascus p a re n ts had hoped a fourth election could be held on the measure, which had been narrowly- defeated. 964 961 The basis of their hopes was a state law governing special elections for school le v ie s T h a t la w , ORS 255 355, states that a school board may call a special election on a proposed levy if it receives a petition bearing signatures of 10 percent of those who voted in the last election held on the levy But when the parents sub m itte d th e 300-plus signatures — more than 15 percent of the 1,925 voters in the previous election — to the schixjl board at its November meeting, they l«*arned from Brown that petitioning for a special elec tion in a school district is disallowed in the case of a defeated B levy That's because when the 1979 Legislature enacted the statute specifying the A' and B’ levy system, it in cluded a provision that a B levy defeated in two elec tions after passage of an 'A ' levy "shall not be submitted separately at an election authorized by ORS 255 355," Brown said B ro w n 's p ro p o s a l is designed to amend that pro vision. allowing resubm ittal of the measure if signatures of 20 percent of those voting in the measure's last elec tion are gathered.
