Bob Dickinson As the legislature concludes its eighth week I find it hard to believe that the time has passed so fast. We are now be ginning to get into controvers ial legislation. Until the last few days, most of the bills have passed with strong majorities. Last Thursday the House got into a I'i hour parliamentary battle the likes of which I have never seen. The original prob lem arose over a minor point. Before we finally did ad journ at noon, we had a few ruffled feathers, and had gone through a host of technical mo tions including a motion to re - refer the bill to commit tee; an amendment; a motion to table the bill; a division' of the House; an attempted Call of the House,' many technical points of order, and several motions to either re- cess or adjourn, The bill final- ly did pass. Tax Hearings Tax hearings continue to bring a constant flow of visi- tors to Salem. Last Friday’s hearing before the judiciary committee on the sex offender bills lasted from 1-6 pm., bringing a large crowd which overflowed from the basement hearing room into the hallway where speakers were set up. A further hearing on the same bills was held on Tuesday evening of this week. There have been many visi tors from Clackamas county in the last week County Asses sor Don Hattan was down again to testify on a matter before the House Tax committee. County Commissioners Dar rell Jones and Fred Stefani were down on Wednesday last. Jones, who is president of the O&C Land Grant Counties Assn., testified along with Su perintendent L. D. Rood of Ore gon City Schools on the O&C matter before the House Edu cation committee. O&C Land Sales Interestingly enough. Darrell Jones tells me. 51 per cent of Clackamas county is Federally owned. By a Federal statute, Clackamas county and 17 other Oregon counties get a total of $15.3 million in funds which are distributed to them from forest sales in what are known as O&C lands. The allocation to Clackamas county is $877,807. Parenthetically, we have a to tal of 1.2 million acres in our county. Indicative of the increasing workload in the legislature, I might give you an idea of how I spent last Wednesday. After early breakfast with some leg islators, I visited a committee hearing briefly and was at my desk attending to various mat- ters before the morning ses- sion. Hearings Lengthy The session concluded at 11:50 a.m. After a very hasty lunch in the house lounge, I was at a noon meeting of the rules committee. I had to leave the meeting early in order to appear before the tax commit tee in support of a bill which I had introduced. The hearing on my bill lasted until after 3 p.m., and I missed my judiciary com mittee meeting which had start ed at 1 p.m. I hastily went to another room and found myself a few minutes late for the education committee hearing which had just started the discussion on the O&C land grants. This hear ing continued until 5:30. It was after this that I had a few min utes to visit with Commission ers Darrell Jones and Fred Stefani. After dinner with a lob byist discussing some proposed legislation, I returned to my desk for a short time. Happily, all days aren’t quite so full as this one was. Mr. and Mrs. Mike Remraen and Mrs. Eliza beth O'Brien of Portland, an aunt. Mrs Kathleen Berry of Vancouver, cousins. Mr. and Mrs. O'Brien and children of Tacoma, and Rowena Brad ley from California were pres ent as were many others of the family. Mrs. Teak Bell, Tully. Steph en and Lynn Bell of Sandy, drove up with the O'Briens. Jolly, Evelyn. Danny and Jim my. Mrs. Bell sang the "Lords Prayer" and the "Rose of Tra lee" for the wedding and "How Great Thou Art" at the morn ing service. The wedding cake, made by Mrs. O'Brien were decorated in Irish motif by Mrs. Elsie Kreiger, a former Dover neighbor. However, there are situations in which the law will not grant the remedy of money damages nor specific performance, as for example in a case where the performance is impossible on a ground which the law finds ex cusable. such as the outbreak of war Relief may be denied in some cases on the ground of public policy, as where the sub ject of the contract is illegal, such as in wagering cases the courts will refuse to grant re lief. What can be done when one party to a binding contract fails or refuses to perform? First, and most common, is a court action for money damages. Such damages are generally measured by the loss sustained by the aggrieved person. The law will attempt to put the wronged party in the position he would have occupied had the contract been carried out. Sometimes money damages will not put the wronged party in the position he would have occupied had the contract been carried out.
