Charge of Tumitercd Juryman Hade $ by Affidavit. Baker, April 30. (Special) Bas ing their claims on two altldavits, which are submitted to the court. At torneys John L. Rand and A. A. Smith yesterday filer a motion asking that the verdict In the case of John Irvin, who was convicted of murder lu the second degree for the killing of J. A. McCraw, be set aside. The motion holds that the trial was unfair, that there was an error in law aud that the evidence was insufficient to Justify the verdict that was rendered. The two affidavits are of a sensa tional nature, especially one, in which the party making same says that he talked with one of lie jurors who sat on the case, and that said Juryman told him that he thought Irvine was guilty and ought to be hanged. A conversation in which the statement was made took place in a local saloon a few days before the trial. The questions asked and an swers of the Juryman when he was hosen are also submitted with the affidavits. The other affidavit is by A. A. Smith, of counsel for the defense. A statement of District Attorney Levens ho holds, prejudiced the jury against the prisoner, although the court In structed the jury not to consider It. The remark which he quotes from the statement of the state's attorney was to the effort that although the counsel of the defense had stated that the de fondant was "doing his duty'' at the time of the tragedy, he was "In a sa loon selling liquor on Sunday."
