A decision overruling the demurrer to the complaint in the case of the city of La Grande vs. Robert Wilkin son, convicted in tne city court of selling near beer to a minor, was handed down today by Judge Knowl es. : In the case of the city va. Atkin son, the legality of licensing near beer was sustained and all the issues In the Wilkinson case covered with the ex ception' of the argument brought forth by Attorney Cochran for the defense that even If the city has a right to license the sale of near beer It has no right to prohibit its sale to minors. In answer to this argument Judge Knowles cites cases where courts have sustained the right of a city to prohibit the sale of cider In quantities less than a gallon and concludes that It Is also a more evident delegated power to regulate the sale of nearbeer to minors which is a regulation.
