A decision overruling the demurrer
to the complaint in the case of the
city of La Grande vs. Robert Wilkin
son, convicted in tne city court of
selling near beer to a minor, was
handed down today by Judge Knowl
es. : In the case of the city va. Atkin
son, the legality of licensing near beer
was sustained and all the issues In the
Wilkinson case covered with the ex
ception' of the argument brought forth
by Attorney Cochran for the defense
that even If the city has a right to
license the sale of near beer It has no
right to prohibit its sale to minors.
In answer to this argument Judge
Knowles cites cases where courts
have sustained the right of a city to
prohibit the sale of cider In quantities
less than a gallon and concludes that
It Is also a more evident delegated
power to regulate the sale of nearbeer
to minors which is a regulation. This
ting minors from entering the near
beer saloons.. '

Judge Knowles points out the fact
that near beer contains alcohol and

harmless drinks to minors, it does
not follow that the council would
not have the right to prohibit the sale
of near beer to minors. Near beer Is
a malt beverage and like all malt bev
erages it contains alcohol. In fact it
is sometimes known as "Two per
cent" indicating that It contains two
per cent of acohol. All authorities
hold that a city council under proper
charter has the power to regulate and

In the places arranged for the spe
clal amusement features there was
dancing, acrobatic performances and
theatrical stunts. In fact one of the
ever recurlng remarks of approval
from the people who visited the ex
position is the fact that the arrange
ments are unique In their provision
for the segregation of the different at
tractions so one cannot interfere in
any way with the others. Observers
who have visited other fairs of 'the
Inland Empire, declare the local peo
ple have excelled, them all in this re
spect. . 1 ;
Last night the booths and displays
were only partially completed, but It
was evident on every hand that the
people were to be given sights of ex
traordinary Interest, in the pavilion
J. A. Thronson of Imbler, has among
his displays the produce of two hills
of potatoes raised without irrigation
18 pounds. "Figure it for yoursel
ves," says Mr. Thronsen, "and you
will see that at that rate the iand
would produce TOO bushels per acre."
Other displays especially noticeable
last evening were those made by El
gin, the Grange and Island City. The
booths were too many and too beauti
ful to give deserving mention In one
article. The park booth, the Pendle
ton academy booth, the display of the
flouring mills, and those of the local
business houses were among those
that will come in for unstinted praise,
throughout the week. v
