W find in the Constitution these pass ages; "Excessive bail shall not be required". "Excessive fine, .hall not be imposed". "Cruel and unusual punishment shall not be inflicted". "All penalties shall be proportionate to the offense". 'Laws for the punishment of crime shall be founded on the principles of 1 formanion and not cf vindictive justice" In our jurisprudence it has com to be a truism "justice should be tempered with mercy." I ask you to compare this pro posed legislation with the fundamental law of the Slate of Oregon. This bill imposes a fine of Three Hun dred dollars and no less for the most trivial offense and it allows no discretion to Court no matter what the mitigating circumstances may be. There i no doubt about the bill being unconstitutional if for no other reason than that it deprives the Court of a right that has never been denied before - the right and duty of exercising judicial discretion. Then there are the pain and penal- lies and the grotesque proposition of making tne men least qualified the pro tectors of public morality. If the people want euch a law as this it can be secured by an initativ vote as provided by an amendment to the Consti tution adopted at the recent election. The duties Imposed upon the Council by this act require it to be possessed of of prophetic vision or omnipotent power so the members can decide in advance that the applicant for a license is a suit able person to run a saloon; that he will not run a business that will endanger the morals of the City; - that he will perform the conditions of his bonds and that the Council believes he will not vio late any law of the State of Oregon or any ordinance of the City. If the Council fulfills its duties strictly, it means that no license can be granted to any person. This ordinance, if enforced, will involve the city in expensive, useless and endless litigation for the reason that the liquor interests will not surrender until after every remedy known to the law has been exhausted. It is time to punish a man after he commits the over act Many men have fallen from the high estate of respecta bility, honor and integrity to criminal. so are we all prone to fall, and as any man may commit a crime, why not try us all in advance, put us under bonds for misdeeds that we may commit. Then again, unless laws are enacted in good faith and upon their merits. I feel justified in withholding my approval while acting in my official capacity as the Mayor or tne t,ity of La Grande.
