MAYOR GIVES HIS REASON FOR VETO

limitations on legislatures and court
when dealing with the right of the people.
and especially as to punishment for crimes
and misdemeanor.
W find in the Constitution these pass
ages;
"Excessive bail shall not be required".
"Excessive fine, .hall not be imposed".
"Cruel and unusual punishment shall
not be inflicted".
"All penalties shall be proportionate to
the offense".
'Laws for the punishment of crime
shall be founded on the principles of 1
formanion and not cf vindictive justice"
In our jurisprudence it has com to be
a truism "justice should be tempered with
mercy." I ask you to compare this pro
posed legislation with the fundamental
law of the Slate of Oregon.
This bill imposes a fine of Three Hun
dred dollars and no less for the most
trivial offense and it allows no discretion
to Court no matter what the mitigating
circumstances may be.
There i no doubt about the bill being
unconstitutional if for no other reason than
that it deprives the Court of a right that
has never been denied before - the right
and duty of exercising judicial discretion.
Then there are the pain and penal-
lies and the grotesque proposition
of making tne men least qualified the pro
tectors of public morality.
If the people want euch a law as this it
can be secured by an initativ vote as
provided by an amendment to the Consti
tution adopted at the recent election.
The duties Imposed upon the Council
by this act require it to be possessed of
of prophetic vision or omnipotent power
so the members can decide in advance
that the applicant for a license is a suit
able person to run a saloon; that he will
not run a business that will endanger
the morals of the City; - that he will
perform the conditions of his bonds and
that the Council believes he will not vio
late any law of the State of Oregon or
any ordinance of the City. If the Council
fulfills its duties strictly, it means that
no license can be granted to any person.
This ordinance, if enforced, will involve
the city in expensive, useless and endless
litigation for the reason that the liquor
interests will not surrender until after
every remedy known to the law has been
exhausted.
It is time to punish a man after he
commits the over act Many men have
fallen from the high estate of respecta
bility, honor and integrity to criminal.
so are we all prone to fall, and as any
man may commit a crime, why not try
us all in advance, put us under bonds for
misdeeds that we may commit.
Then again, unless laws are enacted in
good faith and upon their merits. I feel
justified in withholding my approval while
acting in my official capacity as the
Mayor or tne t,ity of La Grande.
Respectfully submitted,
J. B. Stoddard,
Mayor.

REPORT OF CONDITION JUNE 18, 1906.
United States Depositary
The ingredients of which S. S. S.
bining and preparing them so that they gently and pleasantly build up and
Strengthen every part of the body, make it the ideal tonic for a disordered
condition of the system. Every one feels the need of a tonic sometimes.
The system seems to get "out of gear, " the appetite beconies,.fickle, the
energies are depressed, sleep is not restful or refreshing, aud the entire body
bas a nervous, worn-out feeling. When the system is in this depleted, run
down condition it must be aided by a tonic, and S. S. S. is recognized every
where as the standard. Being made
selected tor their gentle action as well as their invigorating effect on the
system, it will not disagreeably affect any of the delicate members or tissues
as do most of the so-called tonics on the market which conUin potash or
some other harmful mineral ingredient. These derange the stomach and
digestion, unfavorably affect the bowels or otherwise damage the health.
S. S. S. tones up the stomach and digestion, improves the appetite, produces
refreshing sleep, rf da the body of that tired, run-down feeling, and supplies
tone and vigor to the entire system. It re-establishes the healthy circulation
of the blood, acts more promptly and gives better and more lasting results
than any other tonic, and because of its vegetable purity is an absolutely
safe medicine for young or old. S. S. 3. acts admirably in cases of dyspep
sia, indigestion and other stomach troubles, and after using it that uncom
fortable feel-ng of fullness, dizziness or drowsiness, after eating, are no
longer felt. Not only isS. S. S. the greatest of all tonics but possesses puri
fying and alterative properties, and if there is a taint in the blood it will
promptly remove every trace and restore perfect health. In selecting youi
tonic for this year do not experiment but get S. S. S., the recognized stand
