' - To the Common Council of the City of La Grande: Questions have repeatedly arisen as to the authority, jurisdiction or .duties of the Mayor and council, and of the subor dinate officers of the city. These duties, powers and authority are fully defined and set forth in the Chapter, ordinances, resolutions, rules, regulations and special orders of the council. The charter and laws of the state of Oregon cannot be recinded, abridged, amended or repealed by any act of the council. An ordinance passed in conformity with the Charter suspends or repeals all resolutions, rules or orders of the council that may confljqt. with it. In the order of the rank n authority of law and the acts of the Council they stand in relation to eah .ther as follows: 1st The. Charter and laws of Oregon. 2nd. Ordinarsoes of the oity. Sd. Stand ing Rules. 4th. Resolutions. 5th. Adopt ed motions or orders. In a Republican form of . Government we have the three general divisions viz: Legislative, Executive and Judical, with the military subordinate to the civil pow. er, and the police subordinate to the ex ecutive. The legislative branch only has aLthor ity when in session. The executive authority is vested in one person, and all other officers are subord inats in the administration of the law, The judicial interprets the law for the other two, while it in turn is bound by the fundamental law of the state. In our city gove nment we have a blendi g or doubling up of the duties of and functions, which if not fully under stood is apt to cause confusion. . The mayor is member of the council and its pr;ding officer, while members and commi.uas of the council often act in an administrative capacity, and tho police judge acts as clerK of the council, auditor and collector of revenues. The branch of the city government are co-ordinate when the council is in session when the Miyor acts as executive and when the Recorder presides over the police court The Council's powers are supreme, when acting within its chartered author ity, by a majority vote except in case in of a veto which requires a two thirds vote. Members of the council and its com mittees, and the elective ai d appointive officers of the city are subordinate to the Mayor in the excution of the law, " The Judge of pslice court is not subor dinate to either of the other departments when court is in session. Delegated authority cannot be redele- gated. nor can a coun;il confer Ugsa.i.e or administrative powers on its me.nbers or its committees. Committees and mem bers may act under instructions and ac cording to law. but must aiways report back to the council, and their acts must be ratified and appnved by tne council or they have no binding force, cr authority. In no part of the Charter is any authority delegated to the council otiie,' than legis lative. The work of the-committees is ail presumed to be preparatory ork in shap ing matter in their hands to be acted upon by the council when In itssion. When Committees or me-nbers do act in an administrative capacity they are subordinate to the execut v the same as the executive is subordmato to tne coun cil when in session. The same rules of business that are practiced by a well managi 1 private cor poration is the proper meih' d of ru nina tne City's business. The City's bussiness should be run t least as good . s a private concern. The recorder is designate as auditor of the city and it is his duty to sign all orders wh ch may be counter signed by an offi cer in charge of the work or the chair ir.ir, cf the c.:ttc5 ur.dcr v.'hc;; de partment the work is being dona for amounts within $100.00. Above that a special ordinance and contract is required to be signed by the mayor and attested ty the recorder, or tha City is not bound QQ5r4in to seotjon 28 of tha Charter. Custom or usage, ia accepted as the proper lu.le of conduct by the people deel ing with each other as natural persons, but when a person created by law, in the shape of a public or private corporation, enters into, contracts and conducts busi ness, it can only act within its chartered powers, and by and through its legally elected or appointed officers. . Custom or usage in the conduct of the City's business is not binding on the City where said custom is in violation of law, or where ordinances, resolutions, rule or special orders are in conflict with the Charters they are of no avail.
