HAPPENINGS FROM AROUND OREGON OREGON'S NEW WATER CODE. Methods of Registering Water Rights V. Undsr State liw Eslem The following statement Wee prepared by State Engineer John H. Lewis to refute eoroa of - tha ( charges that tba new water law peessd by tba leglslsturo last year Is too Intricate and cumbersome: J ! "Ths assertion bss been made t thai the Oregon water coda ia so Intricate and reetrktivs In its cpsrstlon as to prevent or erectly check tho' use of streams either for power or for Irriga tion. "For tba purpoee of throwing soma light on thla subject a summary of tba mints made under thla law Ini tba state engineer's office between Feb ruary 24 and, December 81, 1909,) baa been ssada, ;'-.',-:,::;-!S i ' "A total of 494 applications for per mits to sppropriste water have een filed, theeatimated coat, of the pro posed work, aa given by tha appll cants, amounting to $30,000,000. : The magnitude of tbeee figures can be ap preciated when it ia remembered that 82.100,000 re preaen ' ad tha total coat of all irrigation works prior to 1902, sceordlng to' the United States eeneua. and it ia believed that 16,000,000 will fully cover all expenditures made since such dste, Including tboaa or tba gov. ernment f "Tba feea paid to the state In con nection with these filings amount to 89.700. a sum which mora than covers tba cost to tha general taxpayer of the state snsrinser'a department No complaint aa to axcessivs fees or un reasonable regulations or restrictions bss been hesrd. Wster right records sre naceeaarily more complicated than land records, and tba applicant or rather those which hsvs sppeared at tha office, aeem to think tha coat dose not exceed the benefits. 8ixty -twoof ths 464 applications bsvs been eeled from the records and tha water ia subject to resppropristion. "lbs wster coda makee no annual charge for tbs use of wster for power development but limits tha franco is or rie-bt to a period of 40 yaara, sub ject to a preference right of renewal under the lawa then ex ie ting. It should not ba confused with a separate law which provides for ao annual tax of 26 eenta to 82 upon each horsepower developed. But little complaint aa to the exceeslvs amount of thaaa raea has bean beard from the email appropriator wbo Intends to spply the power to bis own use. It la different, oowever, itb tha large appropriator and its re tarding; influence is reflected In the small number of such filings made un der this Isw. Only a fsw of tha small approorlatora bsvs paid the tax in ra- aponae to notices sent out prior to Jan uary 2. Forty-nine petitions for tba deter mination of water rights on vsrioni streams of the state have been filed with the board of control. This board ia composed of tha state sngin ser snd ths division superintendent of each of the two dlviaiona into which tha stste is divided. Surveys hsvs been completed and teetimony taken on nine of tbeee streams. All irrigat ed lands, power plants, di tehee, etc, along 1 1 other etrearas hsvs been lo cated and mapped during tha paat a m by tha state engineer. In all, 57,600 acres of irrigated land hsvs been accurately measured and mapped, at a coat of lit cents per acre. The moat important of thess streams are tha Umatilla river and all ita tributaries. Crooked river. Squaw creek and Tomato creek, in Crook county, Willow creek In Mono county, and Willow creek in Malheur county, also Little Butte creek in Jackson county. Tba popularity of tba law with respect to the adjudication of old rights his fsr exceeded the expectation of the legialatura, aa the appropriation for tho state engineer's office ia ao lim ited that surveys cannot keep pace with demaade. No right to tha nee of water can be acquired except by application to, and the ieeuanee of a permit, by the state engineer. Tb reorda as sum marised sbova and tha experience of this office during ths ten monthaof 1909 during which the water coda has been In effect, kade to tha conclusion thst ihis law ia entirely satisfactory to tha prospective investor and settler. It has already stimulated ths develop ment of the stata through Irrigation. Power fillne and doubtless power de-J velopment bss been somswhat retarded by the annual tax provided for in a separata law. DEVELOPMEN X 'SCHEME Company Appliea for Blanket Fran chise In Two Countiee. Medford It ia reported that tba American Development company baa applied for a blanket franchiaa for a trolley lino over all the roads of Jack' son and Joeephine countiee. A certain degree of mystery surrounds tha com' pany in that those whose names appear on tha articles of Incorporation recent ly filed, refuse to divulge tba identity of their associates wbo are euppoeed to ba furnishing the financial backing. Aa yet the principal work of tha cor poration. It appears, bss been to se cure water rights on tba Rogue river in tba vicinity of 8am 'a valley, about It miles north of Medford, ia Jackaon county, and to cloee contracts for 16,000 acres of land to ba included in an extrnslte irrigation project, the water aupply for which ia to ba ob tained from Rogue river. From various soureea it hss been as certained thst the contracts for lands covering an area of 15,000 acres bava been secured quietly during tha past several months, and that water rights on ths Rogus river bsva also been ob tained to insure a aufficient quantity of water for the irrigation of orchard a. It being ostensibly tha intention to provide for Ihe irrigation of tha land and its promotion on ths market in email tracta. The land to tha vicinity of Sam'a valley and Eagla Point ia a veritable desert, but once Irrigated, it ia aaid, it would become moat productive, and as the Rogue river bss a strong flow of water with a good fall, it ia believ ed by those having observed tha coo tour of tha land that irrigation ia feas ible.
