A Dbfbotive Fish Law -The case of the State of Oregon against fcd Copeland was tried In Judge Stephens court at Portland last Tuesday, re sulting In a verdict of "not guilty." This eaee lies been pending sines the close season last spring, and grew out of an alleged violation of the fish law. During the close season prior to April 10th last, Ed Copland was purser, mate and manager of the steamer Kehsni, and while acting -fn audi ca pacity a considerable amount of Chiuook aalnion was found on board the steamer or really in Copeland's possession, whereupoo Fib and Game Watdun McGuire caused his arrest, lie was found guilty at the time in Justice Oeisler'a court snd fined &0. An appeal was taken to the state cir cuit court with the result as above Uted. Thus it appears that the sal mon law as regard the shipping of fish during the close season cannot be enforced. Boras excitement was occasioned on oar streets last Friday afternoon about 4 o'clock when a private citizen Informed the deputy hurlir, who, by tbs way, according to his own atnteaisnt, "(eela himself equal to tbe emergency," that two of the prisoners In bis esrs snd custody wers on their way out ol towa. It wss Charles snd Theodore Drown, who were In for burglary, and noiiimlttnd from Justice Treylor a court at Mayer latit week and wars held to await the action of the grand Jury. The boys bad gone through the name hols In tbs floor of the juil that George Upton used to esesps shout a year ago, Jlufore leaving, however, they did not forget to leave a farewell mesaaga to thoM in whose keeping they wers. It waa something like tide: "Uood bye, Mr. Wheat; we will meet yon in heaven." Tbey then drew a picture repremtntlng one of tbsia In the set of po Inir through the bole In the floor which they left to lllaatrate how it waa done. When the aforeanld private cltlsen bsd In formed the deputy, who was inchnrge that day (Hherlll nice bring in I'nrtlaiiil) thnt the boye were out taking a little exercise In tha mien air thera inatantlr became treat conf iihIoii about the shsruTa oflks. The boya sl tbia time could not bsve been more than three or four blocks awav. and in a few minutea groups of men snd boya were seen going in tne direction the fugi tives were laat seen. A little later s home snd bugiry were brought into action and the pursuit continued. In a few hours, however, the poase wers sll safely back in town, but the "boys" were still pursuing their couras unmolested, sad Ister In the evening were reported to bsve been seen In the vicinity of Deer Inland. B lie nil kics, tninking no aouot, inst ns bsd left his nriaoners in the custody of s person who waa "equal to the emergency,'' had suns to Portland that dav. and of course, waa deeply ahogrined to receive tbs news oi ineir escape. Nothing more was heard of the two es caped prisoners until the sheriff received worn iaie oaiurnay aigm ironi uonsiame Kd. Fowler st Goble that be had the nria oners. They were captured by Constable Fowler while in the art of stealing a boat for the purpose of crossing the river, tiun dav morning they were brought bsck to Juil, snd this time locked up In the steel celts where mcy anouiu nsve neeo sepi in the Hrat place, snd from which there Is no chance for escape. The history of the past has shown that the jail here la not sufficient to hold pris oners unless they are kept in the cells pro Tided for that purpose It is said by some Hist occupants of tbs Jail should not be conllned to the cells, which is an sroneoua ides, l'rieoners are placed in jail for aafe keeping and the sheriff ia Justified in using all tbs means at bia disposal to keep them there. If it is necessary to confine them to the cells fund it seems to be in this tail) tliers tbey should be put and kept there until sued time as tbs court may de cree otherwise. It Is absolutely fmnoe- aible to keen a man in tbia jnil without eomiulng him in tbe steel cells, and if it ia not the intention to ssfely keep bim, what is tbs use of making arrests r CIRCUIT COURT DOCKET.
