Newspaper Page TextHigh Court Opens Lengthy Arguments On Reapportioning -WASHINGTON (LTD - The Supreme Court Tuesday opened marathon arguments on vheth er urbanites are denied a con stitutional right to equal repre sentation in state legislatures. Arguments were to begin or a New York apportionment case as soon as the court disposed of the first decisions and order; of its November sessions. The court heard 24 cases in October and was expected to have a few opinions ready. New York attorney Leonard B. Sand, representing radio sta tion WMCA, its president, R. Peter Straus, and five other in dividuals, was scheduled to lead off arguments on the New York appeal. He is attacking the GS year old formula in the state consti tution for apportioning seats in both the Senate and the Assem bly. New York City and West Chester, Nassau and Suffolk counties are specifically in volved. Pleads For Urbanites The complainants argue that the formula gives vastly more weight to the votes cast in rural areas than to those from c.ties. The ultimate decision on the New York appeal, along with others in Maryland, Virginia and Alabama cases, may pro voke state political upheavals lasting a long time. Poses Question In brief, the court is being asked to decide whether legis latures can be set up on any thing other than a population basis. The court will sit Wednesday and Thursday, and continue the arguments next Monday. Fol lowing the state legislature cases are two from New York and Georgia dealing with U.S. congressional districts. A special tliree-judge federal court ruled against the WMCA group on Aug. 27, 1962. The opinion said the apportionment provisions "are rational, not ar bitrary, are of substantial his torical origin, contain no geo-! graphical discriminations. . ." Assistant State Solicitor Gen eral Irving Gait, who represents New York, is urging the high court to affirm this ruling. West, won with the queen and found himself in an end play. A heart lead would give Paul a chance to ruff in his own hand and discard club from dummy. After that Paul would play tin ace and king of clubs, ruff a club, and finesse against East's king of spades. West chose to lead a club. Dummy's jack won the trick and the finesse was taken against the king of spades. Do you readers see how West might have beaten the hand? All he had to do was to lead the queen of spades when he was in with the ace of hearts, West s three heart bid was one of those pre-emptive jump ovcrcalls that arc designed to upset the opponents. This caus ed North to make the decided overbid of three spades. Paul Levitt who sal South went on to game. West made the fine opening lead of the king of diamonds Paul looked over dummy and didn't like what he saw.
