OR 2-2641 Odds Are That Billy Nunn Won't Keep Death Date SALEM Billy Junior Nunn is scheduled to die in the prison gas chamber a week from Friday for the murder in Jackson County' of 14-year-old Alvin Eacret. But the odds are that he won't.) even though prison Warden Gar-, ence T. Gladden is proceeding with plans for the execution. The execution probably will be delayed while the courts decide whether (iov. Robert D. Holmes can commute the sentence be cause of the governor's opposition to capital punishment. The parents of the Eacret boy brought suit in Jackson County court, which issued a restraining order to prevent the governor from commuting the sentence. This order is temporary. The case has been transferred to Marion County Circuit Court, where Atty. lien. Robert Y. Thornton has asked that -the suit be dismissed on grounds that the court lacks jurisdiction. The Kacrels probably will an swer Thornton next week, after which there will be oral argu ments. Since those arguments probably would be held after the execution date, some action would have to be taken to postpone the execu tion. Orval Thompson, legal advisor to the governor, said that under the restraining order, the gover nor couldn't even postpone the execution until after the court de cides the issue. But either the Jackson or Ma rion County circuit courts could postpone trie date of execution. Affidavit- Charges Kohler Officials Shot Worker WASHINGTON An affi davit charging four deputized Kohler Co. officials shot a man in a liKU riot set off a heated row Thursday in a Senate Rack ets Committee hearing. Lyman C. Conger, the com pany's counsel and one of those accused in the affidavit, angrily denounced the allegation as "a complete and utter fabrication." "If it's made under oath and submitted to this committee it is perjury." Conger said. He said if anyone makes the statement with out the immunity that surrounds congressinn;il hearings "I will sue him for libel."
