Holding that tho defendant had the right to produce evidence to prove thnt the portions of deer, found In his pos session during closed season, were taken from deer killed when the sea son for killing same was open, and that the trial court erred In exclud ing Buch evidence from I lie trial, the Supreme Court reversed the decree of Judge Burnett, of Circuit Court for Linn county, and remanded the cugvi of the slate against (leorge W. Klsher for a new trial. The opinion Is written by Judge Sinter. The portion of the statute under which Fisher wns indicted Is found on page 342 of the session laws of 11107, and reads: "Any person . having Iji possession nny deer or enr cass or part of a deer, during the season when it Is unlawful to Like or kill such deer, ahull be guilty of a misdemeanor." The court holds thnt evldcnco of possession merely makes out a prlnwt facie case and the defendant should have been permltled to show that Ihe deer was lawfully killed, and if he could do this, he was entitled to nn acquittal. At a meeting of the Rosehurg Commercial Club Tuesday evening, arrangements were completed for dedicating the club's new headquar ters on the upper floor of the new Kohlhagen building. Tuesday ev ening, January 12, Ib the day and time set for the event, which prom ises to be one of the most notable in the annals of the organization. Every commercial club In the state will be invited to send representa tives, and in addition to such of these as will come Rosehurg, herself, will furnish a large share of the club's guests.
