During the same period there were five days of frost, on the 17th, 24th, 25th, 26th unci 27th, the last three being designated as "heavy" ones. On the 24th the temperature was one degree below the freezing point, and on the 2Mb !t was still one degree lower. During the first half of the month, however, there were eight days when the tem perature was 85 or over. The av erage rainfall for the month of Sep tember for tho past 32 years Ih 1.07 inches, and there is a defincienoy for last month, as compared with tlu average of the corresponding period of 64-100 of an Inch. The case wns continued until the April term of court, but there is a well-founded Impression that the district attorney will make no further prosecution. After being discharged, the members of the Jury gave out a statement that tho Jury stood 11 for acquittal nnd one for conviction. The jury wns out 2 hours. (Snell, a lawyer by profession, practiced In Medford about ten years ago. He made a specialty nf public land work, and In this connection ap peared frequently in person before the U. S. land office in Koseburg.
