On Sunday, AugUHt 4th, last, near the same place in that river, a young man, son of Jerry Kyan, aged about eighteen, was drowned aud after several vain trials nt recovering the body it was suggested to try the plan above mentioned. Accordingly Minor Taylor took the garment lately worn" by the youth aud that still "laid near the bank where he had deposited it before he went in bathing, and cast it on the surface of the stream, spread out with arms extended and bosom down. Slowly it floated along, Mr. Taylor following in his Bkiff, when abont a hundred feet below it suddenly stopped and plunged down. The pole in Taylor's hand followed right after and struck the bodv. Mr. Taylor related this in the presence of several witnesses who corroborated his statements. Thus was the body recovered. "How did you happen to hit on this plan?" waB asked of Mr. Taylor. "After we had been trying for a long time some one reminded the crowd of the finding of the body of a man near there by throwing iu his shirt. So we just picked up the shirt there nnd put it in the river as I told you, The shirt just stopped aud pluuged right down. I put the pole right down after it nnd touched the body immediately." Information is received of an in teresting case which has just been decided by the commissioner of the general land office, says the Lexing ton Budget. On the 25th of May last Milton Bennett tried to mate final nroof of his pre-emption. He had slept on the land alwajs, but, be ing a single man. he had boarded aud t ,,qi1 -,OT,f ftll Mlo , -f1 niwn , h paid board with his fathers lauii'y, whose house was thirty rods distant. His proof was rejected on the ground of insufficient residence. G. P. Mor gan, land lawyer specialist at The Dalles, appealed the case to the com missioner of the general laud office, and that officer on July 1st reversed the decision of the land office aud gave Bennett the laud. This is quick work aud quite satisfactory to bach elor settlers who are tryiugto comply with the law. but are compelled by circumstances to fail on some techni cality. The purpose of the law 13 to give the land to settlers whose inten tions are honorable, but registers and receivers are not allowed very much latitude by tho department, and iu their decisious usually require a pret ty close compliance with the letter of the law. Iu cases like the above, where the settler can make a good showing, he is often successful on an appeal.
