Janes, of the stato penitentiary, as to the torms of settle ment that should be adopted In adjust ing the claim of Mrs, Mary Waggoner, of Chehalls, Wash., for the return to the Oregon officials of the body of tho convict, Merrill. In fact the dlfferonoo of opinion Is of the most pronounced nature. Huporlntondont Leo has gone on rocord as being opposed to the payment of the reward, or any part thereof In oxcoss of the sum of (300 for tho reimbursement of Mrs. Wag goner for her actual expenses. On tho contrary, Warden Janes takes tho po sition that the entire reward of fl600 should bo (laid to Mrs. Waggoner with out furthor controversy. In discussing the subject with n Journal representative, Warden Jnnos said: "Since there Is not doubt but that tho recovered romalns Is tho body of Merrill there should not be the slightest hesitation on the part of the state In the prompt paymont to Mrs. Waggoner of tho entlro amount named In tho reward. First, bo- cause she returned Merrill's body, nnd because of tho beneficial effect result ing In tho general dlsclplluo of the In stitution; secondly, for tho reason that by Its action In tho matter the state Is retarding the search for Tracy. I do not wish to he understood as particu larly criticising tho Judgment of my superiors, hut at tho same time I have my own opinion, and I do not hestltate to express myself In the matter." Those conversant with tho ac tual conditions on that morning know that Warden Jnnos was on tho grounds promptly, and personally directed the guarding of tho othor prisoners, nnd probably provontod a wholesalo deliv ery, since for a few minutes following the sensation oscnpo of tho two con victs and tho killing of tho three guards, the walls of the onclosuro wore very poorly guarded, and In fact there was nothing to provent mnny of the men from going also..
