After the conclusion of Mr. Qenrln's
remarks, Judgo Ilurnett announced
that tho caso would be continued until
the October term of court.
History of the Case.
At nn onrly hour Wednesday morn
ing, Juno 26th, John I). Fain, n retired
merchant, of Cliampoeg, wns shot and
killed at the rear of the stole of John
F. Markloy, his former pnrtner. Mark
loy was arrested charged with the
crime. He piotestod his Innocence,
but, upon the showing mado nt the
coroner's Inquest, all of the evidence
being of a circumstantial charactor.
the Jury charged Markley with the
crime. The accused man was given n
preliminary examination before Jus
tice O'Donald, who hold tho suspect
to the circuit court without bonds.
Markley wns arraigned In the circuit
court, and mnde application for a con
tinuance of ills case until October term
of court. The consideration of tho
application and the time for ontorlng
a pica woro fixed for Monday, July
7th. Markley pleaded not guilty, nnd
in support of his application for u
contlnuanco of his caso until October,
claimed that he could not recelvo an
Impartial trial nt tho time becnusu of
tho Intenso feeling that existed
against lilm, a feeling that was oven
embittered by tho recent homicide at
the penitentiary. The court hold that
In tho absence of tho consent of the
stnle's attorney to tho desired continu
ance, it was Incumbont upon the do
fenso to make a showing why tho ex
tension of timo should he allowed.
Counsel for defondant filed a number
of affidavits embodying the objections
above mentioned. Counter nflldnvlts

poration, vs. W. A. Omy, appellant;
appeal from Marlon county; Geo. H.
Rurnott, Judge; opinion by Chief Jus
tice Moore; reversed and remanded.
This wns an action to recover on a
promissory note. In 189G W. A. Shaw
ami Win. II. Smith, Sr.. executed n
promissory note for $150 to J. C. Good
ale. who subsequently assigned it to
tho Ooodalo Lumber Company. At
the trial of tho caso In the lower court
a single witness tentlflcd having af
fixed his slgnaturo as a witness to a
document, purporting to bo articles of
Incorporation for tho plaintiff com
pany. Tho court overruled the objec
tion of tho dofenso to this testimony,
and held thnt it was sufficient ovldenco
of plaintiff's oxlstonco as a corpora
tion, hi' passing upon tho caso the
court holds that tho filing with the
county clork nnd the secretary of
state of copies of tho articles of incor
poration, wlillo ovldenco of tho exist
ence of the corporation, It should have
been shown thnt the Incorporators had
carried Into effect tho purposes speci
fied In the nrtlcles. The opinion holds
that at the trial of tho caso It was
necessary to prove the execution nnd
acknowledgement of tho articles In
triplicate, and tho filing thereof with
the county clork nnd tho socrotary of
state. Tho article of Incorporation,
alone ami unsupplutuented hy other
proof. Is held to bo Inadequate to prove
the existence of a corporation, and in
this respect tho lower court orred In
Its Instructions to the Jury. It was al
so incumbent upon the plaintiff corpor
ation to have Introduced testimony
showing that It had been regularly or
ganized by tho election of officers. The
court finds that tho testimony wns suf
ficient to ostnbllsh plaintiff's orgnnl
station as n corporation, and the lower
court having erred In not granting the
defendants n Judgment for non-stilt,
and In giving certain instructions to

lost n steel trap which he bad set for

of George Emory cut In tho steel. It
wns taken to Mr. Emory, who Identi
fied It ns the trap he had lost thirty

the tree, when the growth of the treo
gradually Imbedded It.
