order vacating and dissolving the In
Junction heretofore issued, based upon
the following greunds:
First There is no sufficient reason
given In the complaint, or from any

Second The said court is without
Jurisdiction to issue or maintain the

Mr. Knight also filed a demurrer to
the complaint, alleging tbat the com
plaint does not state facts sufficient

Capital Journal" Succeeds In Securing
a Larger Service From the Asso
ciated Press.
Ever since war was declared against
Spain The Journal has been tryine
to secure the largest telegraphic re
port ever taken In Salem. In addition
to Its regular news report, a special
hullctln service by wire has been
maintained. The following telegram
received today shows tbat we have
succeeded:

From Polk County.
SherltTJ. O. Van Orsdel, of Polk
county, was at Balem today to look
after some public business connected
with his office.
He has orders to buy a new set of
shackles, as the old ones were de
stroyed In the fire.
The tax lists will not bo completed
before the first of August.
The old vault is being moved off the
court house square to the new office
fitted up for the clerk and sheriff.
The county court has asked for plans
and specifications for a new court
house to be built of brick and stone,
to cost not over 840,000. Wm. Brown,
tho pioneer merchant, has donated
the stone, and the city of Dallas the
brick.
It will take 150,000 brick, and if
everything is done this fall It will
be only to put up the foundation
walls and let them stand over winter.
The present Jail Is not safe nor
healthy, but there are no prisoners at
present. There was one Indian in
the Jail and he was released on the
Fourth of July.
The taxpayers aro asking tho court
to build a new court house. It is ex
pected that Independence will Oder
somo resistance by suelng out injunc
tions, but the court Is conservative
and will not act without good counsel.

R.J. Hendricks has today been rec
ommended and probably appointed
appraiser of Customs at Portland,
($3000 n year) In placo of Col. Bummers
who has gone to Manila at tho head
of tho Oregon regiment.

tho Spanish commander at Santiago,
has been officially Informed by Gen.
eral Shatter of the complotc destruc
tion of tho Spanish llcct.and that the
American warships arc now free to co
operate with tho army In the reduc
tion of Santiago. Ho has been given
such time as he may deem proper to
consider the advisability of capitulat
ing with the garrison.
Although General Toral Is appar
ently anxious to resist to tho bitter
end, the utter hopelessness of holding
out against a Rlcgo by land and sea
must be forcing Itself upon him. nis
losses hayo been heavy. Tho rein
forcements ubon which lie was count
ing havo not arrived. General Pando
has left him In the lurch and Is now
making his way accross tho country to
Havana.
Tho food supply In Santiago Is low,
and It Is understood that tho ammu
nition Is running short. Our position
Is being hourly strengthened.
Tho cable operator, who left Santl
ago yesterday, havo been sent back in
order that General Toral may be able
to communicate freely with General
Blanco and the Madrid government,
Tho prospects for the capitulation
ol Santiago without .fulther fighting
grow with each hour's delay.
Tho archbishop of Santiago has ap
pealed to ucneral wanco to sur
render tho city.
SECOND EXPEDITION
Transports Arrived at Honolulu June
Honolulu, Juno 29, via San Fran
cisco, July 8. The steamship Cbina,
of the Manila transport fleet, reached
here from Ban Francisco on the morn
ing of the 23rd, 12 hours ahead of the
other vessels of the fleet. The steam
ship received a warm welcome A
large crowd of people were on tho
wharf. Brigadier-General Greene
immediately sent an adjutant at the
wharf with compliments to United
States Consul. General Heywood and
President Dole, who were on the
wharf, and conveyed them on board.
At 0 o'clock all the soldiers were al
lowed to go ashore. They marched to
Walkl, where the men took a sea bath
and then marched to town, and at 2
o'clock were provided with a feast on
the executive grounds. This function
was carried out precisely on the lines
of the first expedition, Ladles waited
on the tables. The officers were en
tertained at army headquarters.
There was an abundace of refresh
ments for eyerybody.
At 6:30 the same day the Zealand la,
Colon and Senator were sighted. It
was quite late when the vessels
reached the harbor. At midnight all
anchored for the night. The men
landed next day and were entertained
by the citizens of Honolulu.
The expedition started for Manila
on the 24th.
The Monterey and collier Brutus
arrived from Ban Diego on the 24th,
having left the latter port on tbelltb.
The Monterey experienced a heavy
northwest swell nearly all the way. I
She ran under her own steam until
the 19th, and then the Brutus took
her in tow for several days. The
Monterey recoaied and was ready for
sea yesterday morning, but was de
lated by the Brutus, whose engines
required overhauling. Both vessels
left for Manila today.
Ensign T. R. Wall, of Portland, Or.
now on the Brutus, found on his ar
rival here that ordcre had been for
warded which raised him In rank to
lieutenant,
Ex-Queen Lllluokalani is expected
to return to Honolulu July 20. Her
return has no pollticial significance.

Seattle, July 8. George Langdon
who arrived here from Alaska, reports
the wrick of the river steamer Iowa
CO miles below White Horso rapids
June 15. She had aboard a party of
38 j men from Iowa, known as the
"Btarbuck" party. All the passengers
reached shore in small boats, but
their outfits were lost.
Up to June 27, It is estimated that
7000 boats, with an average of four
persons each, had passed through the
rapids.
Stories of drowning in the White
Horse rapids havo been greatly ex
aggerated, but Langdon says four
men had been drowned when bo left.

of them was named Matbeson.

panic has been occasioned by the
withdrawal from exportation of gold,
which caused the Chilian government

prisoners in the county Jail, James
Downey and J. P. Leonard, who were
awaltlLg trial for burglary, attempted
to break Jail Monday afternoon. They
pried out two Iron bars, and one of
them succeeded In escaping through
the Jail window before a discovery
was tttad
nis companion was prevented from
following him by the sheriff, who
forced him back. The sheriff's wife
guarded the window while her hus
band went In search of the prisoner
who escaped. A crowd gathered and
the fugitive was soon found in the
brush and taken back to jail.
Wreck Sighted.
Astoria. July 8. Uhe llgthouse
tender Manzantla has arrived lu port
from a month's trip in Alaskan water.
Captain Gregory reports that when
four miles sontheast of the lightship
he sighted tho after half of a stern
wheel steamboat, floating bottom up.
There was nothing about the rvreck
to lnalcate her name. The wreck its
undoubtedly that of the steamer Ger
aid, which broke In two while en
route to Alaska In tow of the tug
Monarch. Otherwise ;the Manzanl
ta's trip was uneventful.
