D'Arcy for the Judgeship. In the case of P. H. D'Arcy, plain tiff and petitioner, vs. R. P. Boise defendant and respondent, wherein the plaintiff, contests the seat of the defendant, as a Judge for the circuit court, an answer was yesterday filed by Judge Boise, through his attor neys. A general denial of the alle gations contained in the complaint and petition is entered by the defend ant, and for a further and separate answer and defense the defendant and respondent makes allegations as fol fel fol eows: "That soon arter ttic returns from the various election precincts in Marion county were returned to the county clerk of the said county at the election held on the 6th day of June, 1808, at which said election the plaintiff and petitioner, and the defendant and the respondent were candidates for the office of circuit judge of the third judicial district as alleged in the petition on file herein, the clerk of Marlon county Oregon, opened the ballot boxes for the pre cincts of Buttevllle, Monitor. Mt. Angel and Woodburn, and turned the same over to the plaintiff and petitioner, and to certain of his friends and relatives who were acting In his interests and in his behalf, and the said clerk did, then and there turn oyer to the said plaintiff and petition er, his relatives and friends the tally -sheets kept by the first clerk of the precinct last above named. "That about the time last afore said the said clerk procured the tally sheets from the legal custodians tiiereof for the four precincts last named clandestinely and fraudu lently, through the connivance and through the importunity of the plain tiff and potlt'oner and his said rela tives and friends, and the said clerk, the said petitioner and his said rela tives and irlends conniving, conspir ing and confederating together for purpose of cheating and defrauding the defendant and respondent and the people of the Third judicial dis trict concerning the matter of the election of defendant and respondent to the said office did, on or about the time, and at divers times between the 10th day of June and the 20th day of the said month, for the year 1898, change all of the tally-sheets afore said, so as to make it appear upon the face thereof, that the plaintiff and patltloner had received twenty vote?, In the precinct of Butevlllo aforesaid, more than he- actually received; that he received ten voters in the said precinct r)f Monitor, more than ho actually receiyed, and that he received ten votes, In the precinct of Mt Angpl more than he actually received by, at the time last aforesaid, marking the respective numbers of tallies updn each of the respective tally-sheets last hereinbefore mentioned the respec tive number of votes opposite the name of the paid plaintiff and peti tioner, and also by, during the dates lint aforesaid, changing the and forging the ballots in the ballot-boxes aforesaid in the said precinct of Butteyillo, Mqnjtor, Mt. The annex ation, of Hawaii is now . accoui- pllslicd so far as the lcglslatluo branch of thn government" Is; concerned. Quite unexpectedly the resolutions, providing for the annexation of the Islands, were brought to a vote in the senate late yesterday afternoon and they were passed by the decisive yote of 42 to 21. Early in the session of tliu senate conferences of the loaders on both sides of the chamber were held, and a tacit agreement was reached that a vote would be taken today or to morrow at the latest. The opponehls 3f annexation had pratlcally con cluded their arguments, and .is they had no desire to keep the senate In nesslon by purely dilatory tactics, they announced their willingness that a yote should be taken as soon as White, Pettlgrew and Allen had finished their speeches. Neither White nor Pettlgrew spoke at great length, but Allen thought, when he tegan, that his Bpccch might occupy the entire day and part of tomorrow. However, ho concluded to eliminate a part of -the matter he had prepared, and at 4:15 ho com pleted his speech. It wa evident, Instantly, that a yote was at hand. Word was passed swiftlyfl through the corridors and commltteo rooms, and In a few min utes every senator at the capltol was in his seat. The galleries hlled rap idly, and the members of the house of representatives, learning that a vote was to be taken, came hurriedly Into the senate to witness tbe pro ceedings that will be historic. A test vote came on an amend ment offered by White, of California; It was offered with no expectancy that It would bo adopted, but merely to place the Ideas and opinions of the opponents to annexation on record. It was rejected by a vote of 40 to 20, in dicating that the annexationists were strongly In the majority. Amend ment after amendment was offered, but the advocates of the resolutions stood solidly together, gaining rather than losing strength on the succes sive votes. Finally at 5:30 p. m. the resolutions themselves, In precisely the form in which they were received from the house of representatlves.were reported to the senate and the roll call began. Not a sound was heard in the cham ber except the call of the clerk and the responses of the senators. When the vice-president announced the vote by which tho resolutions were passed a tremenduous wave of applause swept the galleries which the president made no effort to check. Merrill, of Vermont, was tho only republican who voted against the res olutions, although Thurston, of Ne braska, and Spooner, of Wisconsin, were paired against them, Six demo crats Gorman, of Maryland; Mc Laurin, of South Carolina; Money, of Mississippi; Morgan, of. Alabama; Pettus, of Alabama, and Sullivan, of Mississippi, voted in favor of annex ation. In the face of the vote for the reso lutions, the treaty of annexation might have been ratified, the resolu tions havjng a two-thirds majority, but as twelyo pairs would have been arranged, on a basis of twp votes for one, If the treaty had been under con sideration, the veto of the full senate on the basis of today's vote, would have been 50 to 33, not a. sufficient number of votes in favor or the treaty to have fulfilled It.
