young recruits from Spokane, In

Kochler and Stringier, passed through
this city enrouto to Manila, There

terms upon which a new lease of the
property might bo obtained from the
manager of tho building, Banker E.
P. McUornack. In ylow of the fact
that their lease expires tomorrow
Patton Bros,, between 10 o'clock and
midnight Tuesday night, removed all
of their scenery and stage parapher
nalia from the opera house and trans
ferred tho ownership of tho same to
Mark S. Skiff In payment of a claim
of some 8400 held by him against tho
opera house account,
II. D. Patton, one of tuo lessees,
was seen this morning and made a
statement concerning tho manage
ment of tho house. "We havo had tne
opera houso leased for two years and
two months, Tho fact that wo have
removed our scenery from tho build
ing does not go to sbow that we do
not Intend to manage tho house any
longer. The scenery has been used
for two years and Is not suitable for
tho Reed any longer. We havo paid
high rent and tho year has not been
a very prosperous ono theatlcally. In
case wo can niako satisfactory terms
with the mannagement wo may ro
loase tho property for another year."

that has boon placed In the Reed since

President Hawley of Willamette
was simultaneously coursing west on
tho same street. lie did not see or
hear Albert In time, and the two
riders came squarely together In front
of Patton's bookstore.
Both flew up Into the air Albert
being lighter went higher, but got to
the ground first. Hawley arose soon
after. Both were a little groggy, and
stood rubbing their heads while a
sympathetic crowd gathered.
Hawley'8 hand was bleeding, his
wheel was wrecked in front, his ball
bearings lying scattered on the
streets.
It was a clear case of mental pre
occupation or syncope somewhere on
tho part of two otherwise Intellectual
giants and skillful riders. Albert rode
off a little stralghter than usual.
Hawley walked towards a repair shop,
leading his animal by tho car.

The examination of the defendants
was resumed at 2:20 this afternoon.
At the request of Mr. Bingham
Witness Roberts was recalled. Mr.
Roberts produced a paper referred to
In his testimony last night. Ho said
he wrote the paper Sunday
night. There were tallies on
tho paper which Mr. Roberts
said ho was Ignorant of. The
paper was found In the sheriff's office.
The paper, which was a recapitulation
of Robert's tcstimoney last night was
placed in evidence,
W. T. Itlgdon, chairman of the
Sliver Republican party was the next
witness, ne testified that he was
present when tho election returns
were counted Mr. Rlgdon ex
plained tho manner In which
tho vote was canvassed by the
board composed of W. T. Hayes,
H. A. Johnson and John
Gelsy. A part of the Tote was
counted '.Itwlce and a part three
times. The vote for circuit judge was
counted three times. On the morning
of tho third day Mr. Ehlcn came In
and said we must go slower than
heretofore and be surt to get It right.
This was the 10th of June.
Mr. Rlgdon was still on the witness
stand at the time The Journal goes
to press.

to expert the county clerk's books at

regular July term.
The bond of tho county treasurer
was placed at $30,000. In the matter
of the payment of deputies clerk for
the month of .Tune it wasordered that
the clerk issue warrants J uly 1, 1898
In payment of Deputies Turner, Mc
Kinney and Glesy warrant to Ehlen
not to be Issued.
The action of County Judce Terrell
in employing Geo. G. Bingham as
counsel for Marlon county in the
suit recently Instituted against the
county oy l.-ii. atinson, was approved.
A Large Estate.
The will of Alexander McNary, who
died in Polk county, June 8, has been
filed, In ;whlcti he set aside 87 acres
and a home for his widow In Hew of
dower. There arc about 095 acres In
Polk county and 1C0 acres in Tilla
mook county, besides 82000 worth of
personal property, constituting the
estate. E. M. Croisan has been ap
pointed executor without bond, as
provided In the will. The heirs are
Elizabeth McNary, -Mrs. E. M. Croi
san and A. A. McNary, among whom
the property Is to be divided equally
The estate aggregates about $20,000
In yalue.
Re. W. E. Copeland, pastor of
Unity church, left this afternoon for
a three months vacation. Rey. Cope
land goes direct to theSound country,
thence eastward as far as Chicago.
He will yery probably go to Boston
for a visit with relatives and will also
spend several weeks In California.
Rev. Copeland's friends at polntn
