To beeln with Lon Bwaru was a habitual drunkard. He was not a stupid sot, a naturally kind- hearted man, a man with an appetite for liquor, that, when gratified, seemed to arouse tbe worst thing aboHt him, a quarrelsome disposition and ungovern able temper. Couple with this condi tion of mind, more or less friction in tbe family and we have bis case, Judge Burnett did well to eeperate the Jury for the tnal at least from the rest of tbe commuulty. No one can j read tho replies of Jurors as reported In The JoubnAL and not conclude that the newspapers, and through them the public, have tried and condemned Lou B warts to be hung, before there was ever a judicial investigation. Tbe craze for sensationalism on the part of the press is such that it is a standing rule of city reporters to present tne worst side ot a case, and always to go positively against the apparent offen der. 8omeone must be condemned, someone must be made a scapegoal, someone must be the victim of tbe community' wrath. On this caeelt was Lon Bwarts. His ungovernable temper, bis quarrelsome nature when In liquor, his drinking habit, bis quarrel with his family, were all ele ments of the case charged to him, sins laid at bis door, he Is made tbe mur derer. Unconsciously all tho forms of justico, the coroner's Inquest, the pre liminary inquiry, the grand Jury In dictment, (which could never be sus- talntd) led up t tbe conclusion at which the community Jumped through the newspapers. The morbid clamor of tbe day la to occasionally demand a victim and the shedding ot someone's blood that society may be purlHed. We say under all these circumstances the Bwarts family are entitled to some sympathy and Judge Burnett, the lawyers and Jury deserve the highest praise for their efforts to secure Bwarts a fair trial, which under the circum stances was well nigh Impossible. The daughters swore the little boy took the shotgun out of the room. Bwarts swore Edward went and took the shotgun down aud that he supposed It was to shoot him wltli. The lawyers for the defense wanted to set up the gun ruck iu thoooutt room and show that it was a physical Impossibility for the hoy Walter to have takeu that gun out of the rack. That request many think should have been grauted hy the court. It might have taken more time, A life was at stake, The point about the gunraak was vital because It would havo shown conclusively whether the girls had made up a story and were lying shout It or not. All seemed to admit that there was a prolonged struggle over the shotgun, The Judge should have rmltted that jiractWal test when n life was At stake, The fact Is the hoy uould not reach the gun, It was tried before wltueseee u the Bills room.
