Tliv m There have been mntiy Inquires at tills ofllco ai to conduct of next Mon day's school election, and qualifications of ejectors entitled to vote. AJouitNAl, writer formulated these questions and submitted them to Bam- ual Itlchardson, Dean of tho low faculty of Willamette University. The qius. tloni aro answered as follews: TltK QUK8TKINB AN8WKKE1). Bhould the Australian ballot bo used at tlio school election in order to mako It Iegal7 No Tho Australian ballot law onlv applies to elections held for the state, county and precinct ofllcers. Our school law simply requires that tho election shall bo by ballot. Seo sec. 34 pogo 20 and sec. 70 page 43, compiled school laws of 1601. Is it necessary before a person Is en titled to voto at a school meeting to have property and pay a tax? No The constitution of Oregon, ar ticle 2 sections 2, 3 and 4, defines who are qualified voters at all elections aud any voter who has resided in the dis trict 30 days Immediately before the election Is entitled to vote at tho school election, no matter whether he owns property or not or pays a tas. Don't you think that section 43of the school law requires that a person to bo entitled to vote must pay a tax In the district, which law reads as follews: "lu all school districts in this state with a population of one thousaud uud upwards, any citizen of this state shall be entitled to voto at a school meeting who is 21 years of age, and has resided In the district 30 days immediately ore- cecdlng the meeting, aud who has property in the district upon which h or she pays n tax?" No This section is intended not only to let all male voters vote, but It is lu tended to allow women who have prop erty upon which they pay a tax to voto also. It does not Bay that a mule voter who does not pay a tax shall not vote, but by its reading It does say tliut u womun can voto, If she owns property in the district and pays a tax. If a law were passed by the legislature making property qualifications neces sary to entitle a male person to voto it would be void. Our eupreme court and also tlio courts of uunv nti,.. states have held that where a constitu tion of a state fixes the qualification of a voter, no law can bo valid that makes any additional qualifications necessary w vmo uuiess me constitution also pro vides that tho legislature may make additional qualifications necessary.
