The hearing set for 1 p. m. today beforo Judge Edf'9 will probably be con tinued also, ponding tho disposition of the matter beforo Judge Hubbard. Idlemau, und Sears, McGinn and Llmson of Portland, and Tiimon Ford. It.Is evidently a right for life and death and will be one of the most Interest ing criminul trials on record. THE CASE Is somewhat as follews: The pris oner claims to bo one Rose, married a few months ago to a Miss Black of Mt. Tubor, who has property there In real estate worth from $15,000 to $25,000. He was ar rested a a fugitive from justice named R. C. Carter, who committed a murder and was sentenced to be hanged at Mt. Vernon, Missouri, six years ago. The man killed was Robert Crocket, who hud given evi dence agalust Carter before the grand jury for having sold liquor without license at his drug store. HIS ESCAPE. Carter was confined In tho county jail until he made his escape six years ago next month, only a few days prior to the date set for his hanging. During bis imprisonment his wife had been very attentive to him, visiting nim every day, and one day some one passed a pistol to him unnoticed by the attendants. That evening when the deputy sherifl ordered the prisoners Into their cells before closing the doors Carter iustead of entering his cell stepped into a dark corner, and an swered "all right." The doors were closed, and Carter remained In the o irrldor of the jail. When the sheriff unlocked tho door Carter shot the olllcer and made his escape, is recognized. Cal Carter as he was known in Missouri is recognized in the person of this man Rose by several people In the city tody. Capt. Batchelor, W. T. Welch and Constable Tom Welch of Salem knew him well in Missouri, about Stockton and Cedarville. Capt. Harris, of MoMinnyille, claims also to haye recognized him this morn ing as he was given a glance at hltn in the corridor of the Jail. ,When Carter saw Harris he immediately dodged back into bis cell and would not come out. This Cal Carter was known as a sport in southwestern Missouri and was always present at horse races and fairs, was considered a violent man who never backed down from any scrape ho got Into. A ma pee. A Journal reporter wormed out some facts today by seeking to ascer tain why so many of the mo3t prom inent lawyers were engaged In the struggle over this man Rose, who was arrested in East Portland by Chief of Police Mlnto. His wife has been communicated with by someouo here and two acres of land worth probably five thousand dol lars and some lots on the peninsular at Portland are put up as security for the fees of defense. A hard fight will be made in the courts to free Rose.
