The state-1 ment that a white man witu mon- I m-,.,1 fVl.iiiilc ,i,l ,i innp lllllnnitK In. di tin occupy similar positions in the eyes of the law is perfectly farcical. More than a year ago "Sandy" Olds shot down a man in cold blood on the stteets In the most brutal manner a murder that was wlt iipsed by a scoieof men. He has twice been sentenced to death, and yet lie lias another chance before the supreme court that may ultimately save his life. As a comparison picture, oueof a gloomier hue, is that of Pelllo, tho Umatilla Indian, convicted on purely circumstantial evidence of murdeiinga squaw while ho was drunk. Ho wassentcueed to be exe cuted to-day without anetlort in his behalf. There does not seem to bo much ovenuess iu the administra tion of the law iu these two cases. MARSHAL RARIN INTERVIEWED. A reporter interviewed United States Marshal Barin with reference to the execution. That gcutlcmuu replied: "I have wired on to tho United States attorney general at Washington to ascertain as to whether any petition had been re ceived by him requesting a stay of executiou. I do not believe thut he has, but when n human life Is at stake I want to bo sure before pro ceeding. I have no reason to be lievo that a stay of proceedings will bo ordered, and the hanging will tako place betweeu 10 a. m. and 2 p. m., but I will not fix tho exact hour till I hear from Washington." Mr. Barin, while ppeaking, was at the courthouse waiting to interview Sheiiil Kelly in regard to the erec tion of the gallows, etc., in the courtyard. THE OALLOWS. Portland, June C The scaffold ou which "Pelllo," tho Umatilla ludlau, Is to be executed was erect ed In the county court house yard yesterday. Pelllo was convicted of the murder of a squaw on the Uma tilla leservation, but he still asserts his innocence. In United States circuit court to-day, Judge Dendy made an order that the remains be delivered either to Dr. Oiuthorn or theOiegon State Medical college. THE TRIAL. Circumstances undoubtedly do point toward Pelllo as the murderer of the Indian woman, but no one saw the ctinio committed. Pelllo was drunk and krows nothing of what occurred. It is not improbable that if he did kill the woman, It wits during a quarrel or light, in which case Peilio might have acted iu self-defense. His case before the jury iu the United States court was poorly con ducted, the prisoner was almost as good as unpresented. The facts in the d e were not properly set be fore the jury and a verdict of guilty was accordingly rendered. It seems strange that no one has Blaine de-j ever taken an Interest iu tills In dian's casj, for there are always persons who uro wllllug and anx ious to assist a condemned murderer, especially when there is even a shadow of doubt as to his guilt. Peilio, howeves, isalonc. Ho w 111 go into the jail yard and be dropped into eternity from a scadold there. He will then bo given a burial In the pauper's cemetery, nnd will then pass out of tho minds of the people who will can but little ! whether his punishment was merit-1 ed or not. DKTAlLSOr TIIK HANGING. "Peilio," tho Indian convicted of the murder of a half-breed woman on tho Umatilla reservation, nnd sentenced Jan. .'iOth, was hanged here to-day by the Federal author!
