within 4 weeks after date of first
publication of this summons, which
date is July 17. 1941, then and there­
to answer or otherwise plead to the
complaint filed herein, and If you
fail so to do, and for want thereof,
the plaintiff will take decree against
you (1) requiring each of you to set
forth the nature of your claim to
lots I to 14, both inclusive, of Block
1, Taylor’s Addition to Nyssa, Mal­
heur County, Oregon, and that all
claims of the defendants adverse to
Plaintiff shall be determined by the
Court: (2) declaring, adjudging and
determining that each of you have
no estate or interest whatever in
said property, and that plaintiff's
title thereto Is a good and valid fee
simple title; (3) forever enjoining
and debarring each of you from as­
serting any claim whatever In or to
said property adverse to plaintiff;
(4) for such other relief as to the
Court may seem equitable; and (5)
for plaintiff’s costs and disburse­
ments In this suit made and incur­
red.
This summons is served on you
pursuant to an order of Hon. Robt.
M. Duncan, Circuit Judge of the
above entitled court, made the 9th
day of July, 1941, directing publi­
cation of summons herein for 4 suc­
cessive weeks and 5 publications In
the Nyssa Gate City Journal, pub­
lished at Nyssa, Oregon.

NOTICE IS H EREBY GIVEN
that the City of Nyssa, Malheur
County, Oregon, will issue and offers
for sale “W ater Works Improvement
Bonds in the principal sum of $13,-
000.00, to be dated September 1,
1941 in the denominations of $500.00
each, shall mature in numerical or­
der in the amount of $500.00 on Sep­
tember 1 in each of theyears 1943
to 1948 both Inclusive, and $1,000.00
on September 1, in each of the years
1949 to 1958 both inclusive, shall
bear interest at a rate per annum
payable semi-annually In accord­
ance with the most favorable bid
therefor, but in no event shall such
rate of interest exceed four per
oent per annum, such interest to be
payable on the first day of March
and September of each year, and
each bond shall have interest cou­
pons attached, and shall be payable
as to principal and Interest at the
office of the City Treasurer in
Nyssa, Oregon in lawful money o f
the United States of America.
All bonds Issued shall be subject
to the option of the City of Nyssa
to redeem same for retirement or re­
funding purposes on any Interest
paying date on and after five years
from issue date upon thirty days
notice thereof given prior to con­
templated redemption date, given
In the manner provided by law.
Said bonds will be issued and
sold for the purpose of financing
certain necessary Improvements to
and in the event of a deficiency in
such revenues, from taxes. The net
revenues resulting from the opera­
tion of the system being pledg­
ed for the payment of
the
principal of and Interest on the
bonds and such pledge shall con­
stitute a first Hen upon such net
revenues.
All bids for such bonds shall be
in writing and shall be accompanied
by a certified check on a Bank doing
business In Oregon, for not less than
two per cent of the par value o f
the bonds offered for sale.

all such bids for such bonds shall
be publicly opened and the bonds

sold to the highest responsi­
ble bidder for not less than 95 per
cent of their par value and the en­
tire amount of the accrued Intereat.
In determining the highest bid
received, the Council of the City
will take into consideration such
premiums as are offered and such
i£ m s o f oost as may be charged by
the bidder In connection with the
purchase of the bonds The Council
may reject anv and all of said bids
and re-ad vert lse the bonds for sale.
