D ear M adam : In reply of your favor of the 25th instant, whether you ran is sue a fishing license to males under fifteen years of age and to females, and if not, w hether they are prohibited from fishing. I would call your attention to the first part of section 53 of chapter 232, page 424. laws of 1900, making it unlawful for any person to hunt or fish without a license therefor. Also, to the paragraph of said section handed "man ner of procuring license,’’ requiring that a license shall he issued upon the appli cation of any person, supported by his affidavit stating the facts therein requir. ed. Further, I would call your atten. tion to the paragraph of said section, found at page 425. reading as follows: "Second. For the purpose of taking or catching trout, salmon trout, salmon or bass by hook or line commonlv called angling, within the State of Oregon, during the open season when it is lawlul to take or catch the same, and if said applicant is a male person of the age of fifteen years or more and a resident of the state, he shall pay said county clerk the sum of $1, and if a non resident, the .sum of *5." You will notice by this last paragraph that licenses are not prohibited to issue to females and males under 15 years of age, but they are not required to pay for the same. Therefore, construing the section as a whole, that persons who hunt or fish must have and carry with them licenses, and that only males above fifteen years of age are required to pay for fishing licenses, it is my conclu. sion that males under fitecn years of age and females are required to have licenses, and that county clerks are re qiiired to issue them upon proper appli cation and affidavit, without fee. The city council, at its last meeting, adopted a new liquor ordinance, and the same was signed by the Mayor yesterday morning. According to it* provisions physicians can write pre scriptions for only half a pint of liquor, and write only one liquor prescription for the same person in one day. Also, in writing such prescriptions physicians must state what disease the "patient*" are afflicted with.
