The Statute »»ays the court in its ruling ■prescribes the method aud makes ample pro visions tor laying out a county road and assess ing the damage resulting to those persons up on whose laud it may be established, but no provision is made in the general act whereby a county road can be located on laud already appropriated to public use. After reciting the stat uary provisiona for ac quiring railroads, the court continues: ‘'The county court of each county exercises over all roads within its 1>orders, and all applies tious for laying out, altering or locating county toads shall be by petition to the count? court of the proper county," and the statue is quoted to show that petition to the county court is not a preequisite to the exercise of the right to appropriate the road (ft a private cor poration, and it is heid that, after a corporation has collected tolls more than io years, a pro reeding to appropriate its property by the county comt may he instituted.
