The Statute »»ays the court in its ruling
■prescribes the method aud makes ample pro­
visions tor laying out a county road and assess
ing the damage resulting to those persons up­
on whose laud it may be established, but no
provision is made in the general act whereby
a county road can be located on laud already
appropriated to public use.
After reciting the stat uary provisiona for ac­
quiring railroads, the court continues: ‘'The
county court of each county exercises over
all roads within its 1>orders, and all applies
tious for laying out, altering or locating county
toads shall be by petition to the count? court of
the proper county," and the statue is quoted
to show that petition to the county court
is not a preequisite to the exercise of the
right to appropriate the road (ft a private cor­
poration, and it is heid that, after a corporation
has collected tolls more than io years, a pro

The facts set out leave the court in doubt as
to whether the alleged attempt of the county
court to acquire the tollroad was under the
general statute or by virtue of the special pro­
visions for the appropriation of tollroads, hut
in any event the question should have been

overruled, the decree »eversed, and the cause
remanded for such further proceedings as may
be deemed just and not inconsistent with this
opiniou.
