Tuesday, October 21, 1963 ' -'"'' Long Court Suit Ends ALTURAS A two-year legal hassle was settled in Alturas Wednesday evening when John L. Montgomery was awarded a $15,000 settlement for injuries sustained in a logging truck and dump truck collision. The acci dent occurred June 8, 1961, on Highway 395 where highway construction was underway. Montgomery received severe burns and head wounds in the accident when his logging truck collided with the hot mix truck driven by Benton Brown. Brown was driver of a Modoc County truck that was sub-contracted to. the highway contractors. The settlement was agreed on during an intermission of the trial for which a jury had been selected the day before. Defendants in the case were Modoc County, Morrison-Knud-scn Company, and Reno Itcdi Mix. Henry Saunders, attorney for Montgomery, argued that im proper safety precautions by the defendants were directly re sponsible for the accident. Tlie $15,000 settlement will be pro rated among tho three defend ants by their respective insur ance agencies. Also, they will be responsible for all court costs.
