tractive lead of his own so he
opens the nine of hearts in hope
that his partner will have a
heart suit.
The lead succeeds admirably
provided that East is i m a r t
enough to duck after the jack is
played from dummy. East
should have ho great problem
here. His only possible re-entry
is the king of spades and the
heart suit is stopped twice
against him.
So East ducks and signals
with the eight spot. South holds
the trick 'in dummy and comes
to his hand with the ace of dia
monds in order to lead a spade
from his own hand.
At this point West has a
chance to duck. This isn't really
a duck, but merely the usually
normal play of second hand
low. If West plays second hand
low South will have no further
trouble making his contract If
East takes his king of spades
the entry for the heart suit will
have been used up. If East
doesn't take his king South
abandons the spade suit and
makes his contract with three
clubs, three diamonds, two
hearts and a spade.
If West rises with the ace of
spades and leads a second heart
the hand Is set because East
will make his hearts before
South gots a spade.

Suit Ends
ALTURAS A two-year legal
hassle was settled in Alturas
Wednesday evening when John
L. Montgomery was awarded a
$15,000 settlement for injuries
sustained in a logging truck and
dump truck collision. The acci
dent occurred June 8, 1961, on
Highway 395 where highway
construction was underway.
Montgomery received severe
burns and head wounds in the
accident when his logging truck
collided with the hot mix truck
driven by Benton Brown. Brown
was driver of a Modoc County
truck that was sub-contracted to.
the highway contractors.
The settlement was agreed on
during an intermission of the
trial for which a jury had been
selected the day before.
Defendants in the case were
Modoc County, Morrison-Knud-scn
Company, and Reno Itcdi
Mix. Henry Saunders, attorney for
Montgomery, argued that im
proper safety precautions by
the defendants were directly re
sponsible for the accident. Tlie
$15,000 settlement will be pro
rated among tho three defend
ants by their respective insur
ance agencies. Also, they will
be responsible for all court
costs.
Montgomery is currently cm
ployed by Jl. A. Briggs in Ore
gon, (Who was employer and
owner of the involved logging
truck at the time of the acci
