Oregon Thursday, June 13, 1963 PAGE 1-C Maugham-Hope Case Heard By French Court NICE, France (UPH A three judge French court heard argu ments in secret for four hours without decision today on whether British socialite Lady John Hope is the legal daughter of million aire author W. Somerset Maug ham. The judges then took the case under advisement without an nouncing any date for a decision. Court sources said the judges might take at least a month be fore rendering their verdict. Because of tlie complicated le gal nature of the various issues put before them, the judges de cided to consider al! aspects of tlie case. The court sources said their re ply probably simply will be a de cision on Lady Hope's claim to be Maugham's legal daughter, from which consideration of other issues in the legal wrangle would stem. Attorneys for Lady Hope. 49, opened today's proceedinus bv asking the court to declare illegal the author's adoption of his male secretary, Alan Scarle, 58, last year. Maugham is 89. After Hie first few minutes, the judges ordered the room cleared of spectators. The action came be fore Maugham's lawyers had a chance to argue that gifts he had showered on Lady Hope should be returned. Lady Hope showed up in the courtroom this morning for the first act of the legal drama. Maugham, who lives in a villa in nearby St. Jean Cap Ferrat, did not. First woman to represent the U.S. in a foreign country was Ruth Bryan Owen, minister to Denmark by President Franklin Roosevelt. The ruling came when tlie high court reversed a decision (rom the Washington County Circuit Court of Judge J. S. Bohannon. and remanded tlie case back to the lower court for further proceedings. The lower court had ruled that Harold J. Hughes had been legal ly adopted, but Hughes appealed the order on the grounds his nat ural mother had never signed the adoption papers. The Supreme Court ruled that although tlie child had been aban doned bv his natural motlier. .Mona Lauanda Nelson, he was still her legal heir. The Supreme Court upheld decision by Oregon Tax Court Judge Peter M. Gunnar which held that a gift in trust for chari ties was non-deductible. Also affirmed by tlie high court was an action by the .Multnomah County Circuit Court of Judge Alan M. Davics in setting aside the jury's verdict and granting a new trial in the case of an in jured longshoreman. Lloyd Strandholm was injured as tlie result of the collapse and fall of a large marine boom where he was working, and he was awarded damages by the jury. Tlie trial court set aside the jury's verdict and set a new trial because improper evidence had been introduced during the first proceedings.
