SAN FRANCISCO (UP) Caryl Chessman, convicted kldnap-raplst turned author, will leave San Quentlmr Prison's death row for the first time In seven years next Thursday. On Dec. 8, Chessman will ap pear before U.S. District Judge Louis E. Goodman to hear a date set for a rehearing of his case. The U.8. Supreme Court on Oet. 17 ordered the rehearing. AS a re ault, Goodman Blgned a writ of habeas corpus yesterday. Last January, Goodman had re- . Jcctcd a petition from Chessman . for such a writ. Chessman then carried his appeal to the highJ court, which ruled It contained enough merit to warrant a hearing. Tin basic question on which the high court ordered the rehearing concerned Chessman's argument that the transcript of his 1818 trial in Los Angeles was faultily pre pared. He claimed It was based on notes made by the court reporter who died before they coujd be transcribed. ' Goodman also issued a stay of execution yesterday afler Chess man's attorney.
