But the 45-year-old New Yorker, who served a prison term for draft dodging, may be ordered to sur render before the year ends at mid night. The U. 8. Court of Appeala indi cated It may announce aometlme this afternoon a decision on wheth er to bar the Justice Department from taking Rubinstein Into cus tody. The 4 p.m. Tuesday deadline set by Alty. Oen. McOranery for Rubinstein's surrender to the New York office of the Immigration and Naturalization Service was almost two hours past when the Court of1 Appeala asked the Justice Depart ment to hold up action while It considers the case.
