The city of Astoria today won In the supreme court its mandamus proceeding against C'laUop county to compel the county court to levy a road tax, part of which would be available for use by the city. The opinion, writ ten by Justice Bean, Is a reversal of Judge J. A. Eakin of the lower court for Clatsop county. The opinion allows a writ of man damus commanding the county court to levy a tax for 1926, and annual ly thereafter, of not less than one mill nor more than 10 mills on all taxable property in the county. Since the proceeding was commenced the time for levying of the taxes for 1923 and 1921 has passed, there fore It Is not possible to make the writ apply to those years.
