' Damage Action Against Local Man Dismissed Clement Bradbury Wing Suit in Fed eral Court MEDFOItD. Ore., Oct. 21. The damage suit filed against Clement Bradbury of Klamath Falls by C. F. Garber of Crams Pass for approx imately 11,600 was dismissed yes terday by Judge YVolverton In the federal court, where It was being heard, because of lack of Jurisdic tion. The suit originally railed for 46. -6oo damages, alleging conversion of grain. I. 1,000 of which was for pun itive damages. This was, however, stricken off before reaching the federal court. The plaintiff's coun sel did not amend the claim so a to read $6,600. County Court Puzzles Over Prison Plans Should the county wait until it has sufficient funds to construct a jail that will last for years to come? Or should it take the 120,000 now available anil build iron cells in what now serves for a jail, on the top floor of the court house? This is tho question which County Judge Bunnell and' Commissioners Martin and Short are scratching their official cranie.nis about now. "To build a modem jail, targe enough to serve our needs for u long time to come it would take $10,000 more than we can now raise." Judge Bunnell said. "Such a jail would provide adequate space for cells and also for the sheriff's of fice. "Of course, that is what we want, but we haven't the money. But with the funds available we can construct cells within the present jail that will make it a far bettor prison than it is now." Monday night the county court remained In, session until 10 p. in. consulting with contractors and en gineers concerning costs and plans. "We have another problem to solve." Judge Bunnell remarked. "That is whether or not the Improve ment we would xm,a of the present jail would he safe. Park of Han Francisco has applied to the state division of water rights for permission to divert waters of the Klamath rivet In Sis kiyou county for utilization In min ing and hydro-electric power produc ing project estimated to coat 110, 000,000. Details of the project dis closed at the office of the division of water rights, show the project lo be one of the most unique on record. Balked by a state law prohibiting the construction of dams on certain stretches of the Klamath river, tho applicant plans to divert part of tho river flow through tunnels, cutting across two bends in the river, His plans call for the taking of the water at the two points opening from tho river bed whence Is would be cSr- ried through tunnels down ward un derground. Divert Kiitire River Mouths ot the tunnels would bo in the river beds, the water being carried downward and emptied Into the river again at lower elevation. The natural fall would permit devel opment of a total of approximately 8S.000 theoretical horsepower, ac cording to Park's estimates. ' In combination with the hydro electric project the applicant seeks permission to cut down the flow of i he river around the bends cut oft by tho tunnels to about one half the normal flow In order to facilitate gold mining in the dried portions of the bed.
