It. The state ami defense both scored in lb' IcHmony and rulings of tin court in lite trial of Tom .Murray, accused convict slayer of Htiaril John dolman In the prison break of August 12, yes terday aflernimn. The most sensalimial disclosure was tile lot i-ihIijcHoii by the slate of a purported confession hy Deft "Oreftnn" Jones, convict who died in tin. break, that he killed liiinseir after ho had been uounslci! and lay helpless tin the gtipund just outside tlio tower nnmbcr i. The alfcged confession was in the form of pages torn from a note book which Warden A. M. Dalryni ple said had been found on or near Jones' hotly. The submission of this evidence was a dramatic mo ment in the trial inasmuch as the existence of such evidence had never before even been intimate. Found by Trusty Warden Dalrymple testified that the note hook was brought to him shortly after the break by a trusty convict named Johnson, a life term er, who said that it had been found on Jones when ijie coroner was examining the body. DRlrympIe said that he found the alleged confession scrawled on several pages of the book in blue pencil and Hint be also found a code and other notations in the book. After tearing the con fession from the book be gave it to Dewey Jones, the dead convict's brother, who offered lo attempt to decipher the code, but was unsuc cessful. The second sensation developed when Dalrymple was cross exam ined by the defnse. The warden was Just about to be released when be stated that he had another bit of information that had not been brought out by the questioning. 'What is it?" asked Will R. King, chief defense counsel. Liberty or Death 'When examining the cell that; had been occupied by Jones and j Ellsworth Kelley the night of the j break the principal keeper and one j of the guards found some band-1 writing on the wall in the sanie j blue pencil," Dalrymple said. "In one place it read 'tonight at I ii o'clock I leave this place dead or alive' and was signed 'Oregon Jones.' lteneath it was written give me liberty or give me death Crowbar Kelley.' Kelley was known as Crowbar Kelley in the prison." The defense failed completely to shako the warden's story of his actions al the time of the break.
