CALEB JONES TO HANDLE ELLIOTT CASE FOR STATE Former Prosecutor Appoint ed to Prosecute District Attorney ANNOUNCEMENT MADE Hearing of Motions on Trial Scheduled for September 25, Before Judge Kelley Caleb Jones, former act ing district attorney, has been appointed by Judge A. L. Leavitt as special prose cutor in the case of State of Oregon vs E. L. Elliott, charged with malfeasance in public office. Announcement of the ap pointment was made this morning and was confirmed ty Mr. Jones. The case will come up for hearing on mo tions the morning of Sept ember 25, before Judge Percy R. Kelley, of Salem, who will preside throughout the case. Mr. Jones was acting dis trict attorney just prior to the appointment of Mr. El liott, and was instrumental in bringing the evidence be fore o ie grand Jiy that led to th t indl'tmcnt of the district attorney. "1 feel ctj hesitancy in accepting the appointment," Mr. Jones said today. "There is absolutely nothing personal in it as 'far as I am con cerned. I was appointed by the court. Hawkins Sees Frame-up In Tracy Charge Investigation to Await Elliott's Return To City "It looks to me as If It might be a frame-up." This was Sheriff Hurt Hawkins' opinion today of the charge that Tom Tracy, court house Janitor and deputy sheriff, had part of a bottle of moonshine whiskey In his pos session last Wednesday morning. "I knew that Huff and Barclay were a bit sore at Trace and I don't believe Tracy would he mixed up in such a deal. District Attorney Elliott is out of lown and nothing will be done until iie returns.
