Before the County Court cau ao quire jurisdiction iu the matter of opening or laying out County Roads every essential requirement of the law, governing the layug out and opeuiug ot Roads, must first lie complied with, for the reason that private property has to tie appropilated for that pui pose, and us it is oue of the funda mental principles of law guaranteed by Article & as Amendatory of the Constitution of the United States, which provides, "that no person shall be deprived of property without due process of luw.
