In making the appoitlonment for 1909 the state board nld be confront ed with the problem of making an ap portionment between Houd Kiver aud Wasoo counties without any law pre scribing how the apportionment shall be made, Ine act creating Hood Kiv er county contained nopiovisou upon this subject, lbe state board passed the question up to the attorney gener ul and that official has advised the board to divide the Wasco county ra tio between Wasoo aud Hood Kiver In proporton to assessed valuations. lfaut the law prescribing the rutio of apportionment of state taxes re quires that Wasoo county psy ,02,'ii of the whole amount. But since then ilood Kiver county has been oarved oat of Wasoo. The assessed valuation of Wasoo county is now $5,927,345 and that of Hood Kiver $2,870,280. Divid ing tba apportionment accordingly Wasoo'a new ratio will be .0158 and that of Hood Kivei .007. Though tsere is no law expressly authorizing auoh an appoitlonment the attorney general expresses the opinon that this is equitable and shoull be adopted. The board nil follow this advice.
