w n r i to mmm 0 u ml inM Jury of Charges of Spying WASHINGTON (UPI)-A fed eral grand Jury has Indicted two men, arrested last week as spies for Russia, on charges of conspiring to transmit informa tion to the Soviets about the command and control system of the Strategic Air Command :(SAC), the government an nounced today. : The Justice Department said :John William Butenko, 38, an ;e 1 e c t r i c a 1 engineer from 'Orange, N.J., and Igor A. Iva nov, 33, a chauffeur for a Rus sian firm in New York, were named in a three-count indict ment. It was returned in U.S. District Court at Newark, N.J. Ally. Gen. Robert F. Ken nedy said the indictment also named three members of the Soviet mission to the United Nations as co - conspirators but not defendants. They are Yuriy A. Butenko and Ivanov were ar rested by FBI agents Oct. 3 in the field operations division of the International Electric Corp. in Paramus, N.J., and had top secret clearance. Ivanov was a chauffeur for the Amtorg Trading Co., a Rus sian export-import firm which operates in New York City. The first count of the indict ment charged that Butenko ob tained national defense docu ments and turned them over to Soviet agents at secret meet ings. The conspirators sought to conceal these meetings by trav eling to them by round-about routes, the government says. The Brand jury charged that the conspirators used a portable 35-millimetcr document copy ing camera which plugged into a car's cigarette lighter, and a pocket-sized transmitter and re ceiver. Nelson Rockefeller of New York, who today announced formally his candidacy for the GOP presidential nomination. Gov. Mark Hatfield said "It will take a personal extensive campaign and winning a ma jority of the important primar ies" for the New York gover nor to achieve his goal. Phil Roth, state Republican chairman, said he felt Rocke feller "at this moment is run ning substantially behind for the nomination." But he felt a vic tory in the New Hampshire and Wisconsin primaries could bring him into the Oregon primary a much stronger candidate. "A victory in Oregon and in the California primary would again propel him back to the center stage for the nomination," Roth said. Lowell Paget, GOP national committeeman, did not forecast Rockefeller's chances. He point ed to the state's primary law which binds the 18 GOP con vention delegates to the choice of the voters at least until after two ballots have been cast at the convention or unless the state's choice receives less than 35 per cent of the convention's votes on the llrst ballot. Mrs. Collis Moore, Oregon's GOP national committeewom an, said "Gov. Rockefeller is a tremendous campaigner and has great personal charm." She said she would rate his chances good for the nomination, although she said she was not certain about Oregon. ' Hatfield and Mrs. Moore said they did not believe Rockefel ler's announcement made it nec essary for Sen. Barry Goldwa ter, R-Ariz., to announce his plans before January. Roth said he believed Goldwater should announce his intentions before then. Paget said he understood Goldwater indicated at Eugene last month he intended to an nounce his plans before Janu ary. All four were asked if they felt adverse effects of Rocke feller's divorce and remarriage were lessening. Hatfield and Paget replied they did not know. Mrs. Moore said, "No, not from the mail I receive." Roth said he felt that once the tempo of the campaign picked up' "with real issues and debate the personal life of Rockefel ler would be obscured and re legated to the backstage of the campaign where it belongs." George Hinman, Republi can national committeman from New York and a Rockefel ler booster, was in Oregon on what he termed "a feeling out trip." He predicted Rockefeller would get the nomination and win. meetings or trips by all the de fendants and co-conspirators as overt acts of the conspiracy. These were between April 21 and Oct. 29, 1963, to Coster, Nor wood, Paramus, Englcwood and Ft. Lee, N.J. Both Butenko and Ivanov were named as defendants in this count. The third count named only Butenko and charged him with actually acting as a foreign agent without notification. Maximum penalty on the first count is death. Maximum pen alty on the second count is five years in prison, and $10,000. The maximum penalty for convic tion on the third count is 10 years and $5,000. SI', Government Auto For King Confirmed By United Press International The Justice Department con firmed Wednesday the truth of charges by Alabama officials that a government-rented auto mobile was used to transport Martin Luther King Jr. to a speaking engagement in that state. The departmennt said one of their attorneys, Thelton Hender son, allowed the car to be used to transport King from Bir mingham to a civil rights rally at Selms, Ala., last month. The department said Hender son earlier denied lending the car. and had been dismissed because his actions violated de partment policy. Gov. George C. Wallace and other Alabama officials cited the incident as evidence of the Justice Department's participa tion in stirring racial strife in the state.
