But Battles' fleet feet couldn't save him. He was captured under an apartment house where he had hidden. Lopez of North Falmouth for bribing an internal rev enue agent, even though the agent was carrying a minifon recorder, which later was played in court. Justice John M. Harlan said the Internal Revenue Service used the device "only to ob tain the most reliable evi dence possible in which the government's own agent was a participant and which that agent was fully entitled to disclose." "The device was not plant' ed by means of an unlawful physical Invasion of Lopez' premises under circumstances which would violate the Fourth Amendment," Harlan said. The Fourth Amendment bars unreasonable searches and seizures. This case involves no 'eavesdropping' whatever in any proper sense of that term, Harlan added. Takas Opposite View Justice William J. Brennan Jr. took the opposite view for 26 pages. He said the only way to avoid situations like the one in the Lopez case was to keep your mouth shut all the time. The Fourth Amendment was not designed to protect secrecy, Brennan said, but to enforce each individual's right to determine to whom he would communicate his thoughts. The high court ruled In 1028 in a famous case that wiretapping did not constitute an unreasonable search. This decision, according to Brennan, arose from the fact that "the framers of the Con stitution had not been far- sighted enough to foresee the Invention of the telephone. Brennan and two colleagues Justices William O. Douglas and Arthur J. Goldberg - said it is about time the 1928 rul ing was cast aside. The course of the court's decisions has been "out-flanked" by tech nology, they said. 'If electronic surveillance by governments becomes suf ficiently widespread, and there is little in prospect for checking it, the hazard that as a people we may become hag-ridden and furtive Is not fantasy," the Brennan opin ion said. Wilderness School Outlined by Bjerke at Chamber Roundtable Future plans for a school I last summer in the Three into the mountains. Bjerke of 10 to 1. i in Mprifnrri fnr Hphrinfino ar. i ho in ii .i , Future plans for a school designed to teach people how to survive "off the land" in a wilderness area were out lined by the school's founder and director at Monday noon luncheon of the Mcdford Chamber of Commerce Roundtable. The director. Odd Bjerke, a native of Norway, said the staff for the school has al ready been selected and that applications are being re ceived for the first session, which is scheduled for June 24. Fee for the 10-day train ing course is $115, and any one over 14 years of age is eligible for enrollment. In formation about the program may be received by writing to post office box 1181, Mcd ford. By way of illustrating the activities of the training ses sion, Bjerke showed a color film taken of a survival trip made by a group of 20 persons last summer in the Three Sisters Wilderness area. Bjerke explained that a two-day school was held prior to departure for the uplands to offer "academic" instruc tion on some of the basics of outdoor existence and condi tion them mentally for the experience. During the inter val, the trainees "ate well", Bjerke said, to prepare them "for the ordeal ahead." "We turned down 75 ap plicants for the trip," he said. "This is not a boy's game." The speaker stressed the im portance of "attitude" in out door survival, noting that it can often make the difference whether "one comes out alive or not." He said two men failed on the trip last summer for "psy chological" reasons and had to leave the group to return to civilization. Mark Hatfield did not hold his reg ular weekly news conference today. into the mountains, Bjerke said, except clothing and a survival kit containing a few basic essentials like fishhooks, knives, twine and a piece of foil with which to cook. No food was taken on the outing. A brightly colored parachute was included for use as the covering for a teepee. "The first few days were the hardest," the speaker said, "because the men were reluc tant to eat slugs, snails, snakes and fish-head soup. But they soon got used to eating what was available." Members of the group were given instruction in a variety of activities, including build ing snares and traps, shelter construction, preservation of food, edible plants and ani mals and primitive cooking. Values Changs Bjerke remarked how dif ferent a man's values become in the wilderness. "Out there. it's not what you own," he said, "but rather what you are that counts. In Medford, a $50 bill will buy a lot of groceries, but in the moun tains you might be grateful to be able to light a fire with it." On the fifth day, in the vicinity of the south Sister mountain, an airplane made j a food drop containing chick en and ice cream. It was the i only deviation from the "live- i off-the-land" policy during the 10-day trip. The scenery was spectacu lar and varied on the trip, he said. The party crossed three live glaciers, and encountered one "dead lake" that actually had iceberg's floating in it. He described the area around Kidney lake as a "paradise" abounding with fish, grouse, rabbits and squirrels. Selection of Medford At the conclusion of his presentation, Bjerke was asked why Medford had been selected as the site for devel-! opment of the Wilderness Sur vival school. He replied Med ford was an ideal location be- J cause of its position between metropolitan areas to the north and south. He said the variety of flora and fauna, together with the abundance of lakes and streams in the high country, also make the location suitable. The climate, too, is good, he said. The school this summer will feature a three-day academic period, followed by a seven- day outing in wilderness areas either around Marble moun tain, or in the Trinity Alps in northern California. Bjerke said he expects to ; have about 30 people in the field at one time. A medical doctor will go along on each outing, and there will be suf ficient instructors to main tain a pupil-instructor ratio On the morning of the 10th day, the students will return to the academic school site in Medford for debriefing ac tivities and a prepared meal. Each student who successful ly completes the course will be given a diploma ami a school insignia, according to a brochure describing the) school. SMUDGING'S OVER!
