8 C Irrigon Residents Seek School District Heppncr -TOPD- Twenty-one residents of Irrigon in Mor row county have petitioned to withdraw from the Mor row County School District, the first county-wide district formed under the 1957 School Reorganization Act. The petitioners asked to re main in the Morrow district for elementary schools, but want to form a high school district with the Umatilla dis trict. FORM OF SUICIDE Charlotte, N.C.-WPfl-A phy sician told the American Col lege of Surgeons Wednesday that smoking was a deliberate "form of suicide." "A bullet is quicker, cheap er and a whole lot less painful than lung cancer," said Dr. Al ton Ochsner, surgery chief of Ochsner Clinic and senior sur geon at the Touro Infirmary in New Orleans. CRIMINAL AND CIVIL LAW When two cars crash, for Instance, two kinds of law may sometimes go into play. One is criminal law and the other, civil law. Under criminal law, the po lice and district attorney look into the accident and may de cide that one or both parties broke a traffic law. In a criminal action, the prosecutor must prove beyond all reasonable doubt that the driver broke a certain law. If the court finds that the prosecutor did not prove the crime beyond a reason able doubt then the state will lose its case. The accused will go free. "Contributory negli gence" is no defense to a criminal action. The second kind of action which may grow out of an auto accident is a civil action. Anyone hurt in the crash may sue the driver or owner of the other car, asking for money damages. In a civil ac tion you have merely to show by a "preponderance" of the evidence, that the other party caused the accident. You as "plaintiff" do not have to prove your case beyond all reasonable doubt. But you must retain your own attor ney and bring suit to collect damages. May Reduce Liability Moreover, in a civil case, unlike the criminal case, other legal doctrines such as comparative negligence or as sumption of the risk may re duce or remove all liability. So a person may be held criminally liable and yet de feat a civil suit where the proper defense is available to him. Likewise, one may be held liable in a civil action and yet found not guilty in a criminal action. This can be because of the greater bur den of proof needed for a cri minal conviction, or because not every case giving rise to liability in a civil action is made a crime. Schedules Event ; Here on Thursday Mrs. Hale Pragoff, recently assigned by the Oregon state ; board of health to form and direct volunteer services for the aged, will speak here Feb. 21 at the fifth annual meeting of the Rogue Valley Council on Aging, Omar Bacon, presi dent of the group, announced. The noon meeting will be held at the Red Cross build ing on Hawthorne ave. and a light lunch will be served for a nominal fee and coffee fur nished to persons, who wish to bring a sack lunch. Bacon said. Because of the financial and humanitarian aspects in volved, the state board of health added the volunteer services for the aged program to the chronic disease and li censing of care facilities divi sion, the health committee of the Council on Aging recently reported. Topic for Meeting Mrs. Pragoff's topic for the Medford meeting is '.The Value of Volunteer Services to Your Community." She has had considerable experience as a medical social worker and with volunteer groups. Anyone interested in the council's program is invited to attend, Bacon said. Election of officers is on the agenda for the Thursday meeting and reports will be made by major committees, including recreation, housing, senior citizens center, and health. The Rogue Valley Council on Aging has, in the past, sponsored such activities as the 50 Plus clubs in Medford, Ashland and White City, the Senior Activity Center and the Friendly Visitors Service to Nursing Homes and em ployment studies. Musical Program Presented by MHS Students at Lunch Nine Medford High school students presented a musical program and the Kiwanis Ka pcrs show was outlined yes terday at a Medford Kiwanis club Valentine luncheon at Rogue Valley Country club. Wives o members were guests. The musicians were the Checkmates, a vocal quartet, and a Dixie land band. Vocal ists were Pat Selby, Chris Helman, Jackie Long and Jean Allen from the choir. They were accompanied Ly Jim Arthur. From the high school band were Paul Jenny, Ron Harris, Paul Goodwin and Scldon Van Sickle. Miss Long sang a solo, "One Boy," from the forthcoming school musical production, '"Bye Bye Birdie." Outlines Kapers Plans Dr. Abner Clark, talent: chairman, outlined the Ka pers production, "Well, Flip My Wig," and listed the pros pective cast. Professional Di- j rector Bob Gregory spoke briefly concerning the show which will be presented Feb. 27 and 28 and March 1 and 2. The show was discussed in more detail by Gregory last night at a "meet the director" parly at the high school band room. Casting was finalized for most of the roles and re hearsals were to begin today. Carl George, .student at St. Mary's High school was intro duced at the luncheon by Scoutmaster Richard Swan as an outstanding member of Boy Scout Troop 2, which is sponsored by the Kiwanis club. George is a Life scout and junior assistant scout muster. Dr. Scott Jennings, an osteo path, was introduced as a new Kiwanis member.
