PEARSON Salem-ft!PII-A hearing on racing bill that generated shouting and gavel-pounding Monday will continue next week despite elimination of its chief target, Rep. Edward Whelan (D-Portland) said to day. The chairman of the House Planning and Development Committee spoke shortly after the State Racing Commission denied David Funk's applica tion to build a dog track t Wilsonville in Clackamas county. The committee is holding hearings on a bill to limit horse and dog racing tracks in Oregon. "I am convinced the com mittee still wants to push this bill through to Bar any ruiure efforts like Wis," wneian said. The shouts and accusations broke out Monday while Ar chie Weinstein of Eugene was testifying before the commit tee. Weinstein at first identified himself as "just a citizen," but later admitted he was associ ated with Funk. Weinstein said the bill was aimed at "perpetuating a mo nopoly" on horse and dog racing in Multnomah county. "I protest this type of testi mony," shouted Rep. C. R. Hoyt (R-Corvallis), one of the sponsors, rising from the audi ence. While Whelan pounded his gavel, Hoyt demanded that Weinstein identify himself un der oath. Turning to Hoyt, Weinstein replied that Hoyt himself had not testified under oath. After being warned by Whelan that he would be dis missed from the stand, Wein stein gave his name and ad dress and said he operated six surplus sales stores. Owns 300 Shares Only later did he admit he owned 300 shares in a racing corporation headed by Funk, and was "working with him on that track in Wilsonville." The bill before the commit, tee would prohibit horse or dog racing tracks within 100 miles of each other. The hear ing will continue next Mon day afternoon. Opponents of the Funk pro posal testified before the legis lative committee in support of the bill. Their arguments cen tered on money and morals. B. J. Gilbert, vice president of Portland Meadows, said a Clackamas county track "would hurt us." He said it would cut into the number of racing customers in the Port land metropolitan area. HB2007-Relatlng to the fi nancial administration of the Oregon Board of Examiners in Watchmaking and Clock-making, unday Barton, Musa Believe Job Not For Legislature Salem -UIPD- Thousands of letters opposing the proposed Sunday closing law flooded over legislators' desks here today. House Speaker Clarence Barton and Senate President Ben Musa both said today they did not feel it was the legislature's job to enact such laws. Barton said he received "15 or 20 letters" on the plan Monday from Seventh Day Adventists who oppose the idea. Musa said his wife, Rep. Catherine Musa (O-The Dalles) received a "whole bunch" of mail, and he had been visited by three Seventh Day Adventlst students who opposed the measure. "When we start making laws to restrict ' people, it's the wrong approach. It's whit tling away some more of our freedoms," Musa said. Not Legislative Job Barton'sald "I don't think this is a legislative Job. Croups can work these things out among themselves." He cited instances where banks volun tarily joined to close on Sat urdays, Barton said the Sunday closing bill, proposed by the save a day for the family committee" would be sent to the House Planning and De veloping committee. I think there 11 be some amendments made," he added. "This is economic, pure and simple. It's a cleverly drawn bill. I wonder why they (the sponsors) ovelooked some of the other segments of the econ omy. What about a day off for food store workers, bar tenders, waitresses? They have. some rights, too." Fair Hearing Assured Barton assured "the bill will get a fair hearing." While commenting on re ports that more than 5,000 letters against the bill had hit the capitol, Barton said, "Now, when the green stamp bill comes in . . . well . . ." He said he understood the anti-trading stamp bill would be Introduced shortly. In other matters, Barton said he was not concerned now over delays surrounding the Boardman project. He said he did not expect any major development of the space age park until the John Day dam was completed and deep water was available at the site. Laison Said Needed Musa, who served as gover nor Sunday and Monday, said there should be some liason between the governor and the senate president. He said his only official act while gover nor was to recall the National Guard units from the Baker flood area Sunday night. "I realize this thing (Hat field's out of stale trip) came up quickly," Musa said, "Maybe next time there will be time for a briefing." Ed California Governor's Budget Greeted With Mixed Reaction Sacramento -IUPII- Gov. Ed mund G. Brown's $3.2 billion spending proposal for fiscal 1983-64 was greeted with mixed reactions by Republi cans and Democrats in the leg islature today. The huge budget largest for any state in history was introduced in both houses Monday. On the surface. T. W. Wilson, an associate, said it was believed Graham was not seriously ill. A hos pital spokesman called Graham's condition satisfac tory. Graham became ill Satur day after speaking to the an nual Layman's Leadership In stitute in Dallas. His associ ates thought the 44-year-old Graham was suffering from influenza. He was hospitalized for rest and treatment to speed his recovery. His fever rose to 102.6 degrees Sunday. PASSES FIRST BILL Washington-tUPD-Tlie House passed its first bill of the 8Bth Congress Monday. The bill, which now goes to the Senate, would allow paying burial allowances in cases where a veteran's discharge was changed from dishonor able after his death. HERTZ WIDOW DIES Miami Beach-iliFli-Mrs. John D. Hertz, well-known horse owner and widow of the founder of the Hertz car rental system, died here Mon day at the home of a daugh ter, Mrs. Paul L. Burns (D- Fresno), one of the Democrats' most important members in the legislature as upper chem ber president pro tempore, had this to say: "I have heard and noticed growing opposition at the lo cal level from businessmen and taxpayers with respect to the withholding of personal income taxes. This will be dif ficult to sell and I am not yet convinced that I can sup port such a program. Assembly Speaker Jesse M. Unruh said he supported the broad general outline of the Typographers To Vote on Assessment Colorado Springs, Col.-WPIl- Locals of the International Typographical Union will vote Wednesday on whether a spe cial union assessment on wages will be ordered to help striking newspaper printers in New York and Cleveland. The members of more than 700 locals in the United States, Canada and Puerto Rico will take part in the ref erendum. There are about 115,000 members. If approved, the assessment is expected to be about 3 per cent. Elmer Brown, ITU pres ident, said such an assessment would raise "at least $1 mil lion a month." The union's constitution re quires that all assessments must have a terminal date. The terminal date on this one, if approved, would be one year from the effective date, Brown said. In his budget message, Brown proposed two major lax reforms-the withholding principle and elimination of the installment payment priv ilege on Jan. 1, 1964. He said these and other re forms were "long overdue" and suggested that to make the tax more palatable the state's taxpayers be given a 25 per cent "forgiveness" for taxes during calendar year 1964. Other developments: Education - Assemblyman Charles B. Garrigus intro duced a $121 million school finance bill including a coun tywide equalization tax. He said the bill embodied propos als approved recently by the State Board of Education. Narcotics - Sen. Donald Grunsky (R-Watsonville) in troduced a bill to legalize evi dence found by police during a search of homes and auto mobiles admissible in court for" narcotics violation convic tions. WCA Plane Makes Precautionary Landing Redmond-IUPD-A West Coast Airlines DC-3 landed safely here Monday after it devel oped trouble in its electrical system on a flight from Klam ath Falls to Redmond. Only the captain, co-pilot and stewardess were aboard. West Coast officials said the plane had no difficulty in its landing. Another plane com pleted the scheduled flight to Salem and Portland.
