PS."H ASS COLO, Dennis the " Well, if the1 dotixMAKS Iff - -ii"'-if 1 THE NEW TAX LAWS' MEANING TO YOU VII EXPENSE ACCOUNT LIVING HIT Under the new tough expense clauses in the 1962 Revenue Act, your tax break on combined business-pleasure trips will be cut down considerably. Up lo now, you could combine some pleasure with a primarily business trip and still deduct the entire cost of your flight to and plus the the cost of your stay in San Francisco as business travel expenses. But the new law says that, starting next year, if your trip takes more than one week and if 25 per cent or more of your time Ls for personal activities, the travel expense de duction must be cut proportionately. If you look precisely this same trip next year, you'd come under both the above new rules a trip away for more than one week and more than 25 per cent of the time spent on personal pleasure. As a result, only half the cost of your flight from New York to San Francisco would be deductible. The cost of on week business stay in San Francisco would continue deductible, though, while your pleasure stay in the environs the second week would be non-deduclible as before. Note that if your whole combined business-pleasure Irip doesn't run over a week or if the business pari is more than 75 per cent of the total trip, you still will be able to deduct the entire travel expense. If you spent three days at the business convention and three days -on pleasure, you could deduct your entire plane fare. Club dues, boats, similar entertainment facilities. From 1963 on, you'll be able to deduct club dues, cost of operating boats, hunting lodges, etc., only if your expenses meet two new tests: your entainment facilities nvist be used more than 50 per cent for your business purposes; if they meet this first test, they also must be "directly related to'' your business. The more than 50 per cent business use test is measured by actual use, not by availability for use. Say you have a year's membership in a golf club and use it on 30 different days. If you golfed with business customers for 16 of those 30 days and for personal reasons the other 14. you pass the more than 50 per cent use test for deducting a portion of the annual dues. Even if you fail the more than 50 per cent lest, you may deduct other qualified expenses connected with your use of entertainment facilities. For instance, if you golfed with customers on only 14 of the 30 days in the above txompia, you couldn't deduct any part of the year's club dues, but you could deduct the business lunch costs you paid entertaining customers on those 14 days. Estimated expense account outlays. Up to now a business nr professional man who couldn't prove exactly how much he spent on business entertainment, travel or gills has been allowed to deduct a reasonable estimate of these amounts under the famous Cohan rule, as developed by the courts and followed by the Treasury. Bui this will be out starting in 1963. ,, , To be sure of idling your deductions, you must collect adequate records or supporting evidence for your state ments so you can prove to any agent examining your return (1) the amount of your outlay; (2) the time and place of the travel or entertainment; the more than 50 per cent business use of the entertainment facility, or the date and description of the gift; (3) the business purpose of the outlay and (4) your business relationship to the persons entertained or using the facility or given the gift. You should keep a clear and detailed business diary, save receipts, cancelled checks, the like, to back up your diary items. If vour return is examined and your expen.-e deduc . tions question, your own statements that you spent the amounts listed on your return will not be enouah o mkc your deduction stand up. This is in conformance with a long standing policy that a hazard of this nature is a re sult of the elements and the effect of salvage operations is a reduction of this hazard. However, a permit to harvest timber and to operate power driven machinery will still be required and normal responsi bilities retained while operat ing in the area, he added. Foresters and timber own ers, facing the possibility of an insect epidemic emerging from the downed timber, are gearing their plans to salvage this material, thereby depriv ing the beetles of board and lodging. Lesser wind storms in 1949 and 1951 unleashed a beetle attack of huge pro portions. Preliminary estimates indi cate that upwards of 2.6 bil lion board feet, over one- fourth of the timber volume harvested annually in Oregon, was blown down.
