'Nervoui Collapse'
Held on-ihe-Job Injury
An employee of a railroad
was required to operate a sys
tem of central traffic control
for the railroad. The job was
apparently too much for him
and he suffered a severe nerv
ous collapse. He sought to re
cover damages against the
railroad under the Federal
Employers' Liability Act
which made railroads liable to
a person suffering an "injury"
while employed by the rail
road and because of the rail
road's negligence.

that he was subjected to

"working conditions of unusu
al responsibility, stress and
tension." He said the system
he was required to operate
"involved multitudinous and
complex mechanical factors
and mental decisions, extreme
responsibility, constant but
shifting attention, and numer
ous clerical functions which
. . . imposed an unusual stress
and burden upon his physical
and nervous systems." This,
he claimed, caused the "nerv
ous collapse" which rendered
him "sick, sore, lame and dis
abled." THE COURT HELD: The
employee was entitled to re
cover damages for the injuries
resulting from the "nervous
collapse." The California Su
preme Court pointed out in
this 1960 case that the Act
did not qualify the word "in
jury" by "accidental" or "bod
ily." It said that the injury
might well, result from negli
gence pursued ove? a period
of time and did not have to
be inflicted suddenly. (McMil

road Company, Cal., 357 P.
2d 449.)

parties said Sunday they op
posed use of American troops
in Laos because of the diffi

Reds.

Sens. Wayne Morse (D-Ore.),
Jacobs K. Javits (R-N.Y.) and
George D. Aiken (R-Vt.) ex
pressed similar views. Morse
and Javits said U.S. troops
should be sent to Laos only
if other SEATO allies acted
likewise. .
Aiken said landlocked Laos
was "about the worst place
in the world"-to fight a war.
But he said the United States
would have to take "vigorous
action" if Thailand were en
dangered. Pressure for Reforms -
Administration officials said
that the United States had
decided to link its offer of
increased military aid to
South Viet Nam with strong
er pressure for domestic re
forms in that country.

arranging the party, but Tru
man and Benny were expect
ed to stage a brief "concert"
for the 200 persons attending
the hotel party-Truman play
ing the piano and Benny his
famed violin.
