'- The penalty fixed Wednes day by the jury of 10 men and 2 women meant the lovers, Who were found guilty of kill ing the surgeon's wife, will vie eligible for parole after serving, seven years. ' Attorneys for the convicted murderers said they will ap peal the case it motions for a new trial are turned down at formal sentencing April 17, ' Finch,' 43, and Carole, ,.24; were convicted 10 days ago. at their third trial in the shot-tn-the-back murder of tho sur geon's wife, Barbara Jean, 33, on juiy la, laow. The state board that rules on parole can withhold It for an indefinite length of time or refuse it completely, de pending on the nature of the crime and a convict's behavior In prison. The lovers - reacted with tearful relief and at the same time the shock that came from knowing they might spend the rest of their lives in jail: "No, no, no," Carole said. "I'll be an old woman when I get out." She started to sob.- Finch, separated from iher at , the counsel table by .her lawyer, Don Brlnggold, reached hU left hand to touch her right farm and said: , ; ; , i "We'll fight it, darling. We're still alive." . Carole recovered her com posure quickly and walked firmly from the courtroom. But Finch, suddenly over come, put his hand palm down on the table, hung his head and wept for nearly three minutes.-. There were pools of tears on the table when he left. Finch was sentenced to life on both his convictions: for first-degree murder and con spiracy to murder. Carole, his mistress,' was sentenced for conspiracy, which, like first degree murder, carries a pun ishment of the gas chamber or life. r -r J'"- '?'.''; ' She also was convicted of second-degree murder, but the judge told the jury to ignore its automatic penalty of five years to life since the con spiracy sentence made it mean ingless. , "We'll go as high as the Supreme Court if necessary," said Brlnggold. He said he "thanked God" the jury had spared Carole but added: "We will free this girl and prove her innocence to the world. If she is granted new trial, it will be the be ginning of a long, hard fight.' Senate Committee Hears Praise for Kennedy's Army Modernization Plan Washington-UPB-Army Sec retary Elvis J. Croups taking part include the Medford public schools all-elementary orchestra, the McLoughlin Junior High or chestra, Hedrlck Junior High orchestra, the Medford High school orchestra, and the com bined groups. The concert is under tne di rection of John E. Drysdale, orchestra supervisor. Doors will open at 7 p.m. and there will be no admittance charge. Each group will play three selections and, as a finale, the combined groups will present "The Star Spangled Banner." Individual directors include Elmer Ayres, McLoughlin Junior High and elementary; Miss Alice Saunders, elemen tary: Al Huntemann, elemen tary; and Drysdale, elemen tary, Hedrlck Junior High, and Medford High. i The performance Is the or chestra complement to the all school band festival which was held at Hedrlck Junior High late last month. Measures Signed By Gov. Hatfield Salem - (UPD - Gov. Mark Hatfield today signed into law a bill prohibiting further state-ordered sterilization of epileptics. Other bills signed by the governor: HB1104 - Ballot marking. HB1129 - Relating to wel fare commission reports, HB1292 - Relating to state library funds. HB1522 - Permitting two polling spots in the same building. HB1542 - Relating to motor carriers. in prepared testimony before a closed-door session of the Senate Armed Services Com mittee. He was accompanied by Gen. George H. Decker, Army chief of staff. The secretary praised Ken nedy's recent proposals to in crease the army's manpower, its non-nuclear firepower and its battlefield mobility. When these modernization programs are put into effect, he said, it will permit Army forces to make "deliberate choices in weapons and strat egy" that will reduce the danger of a small war turn ing into a large one. . Stahr said great mobility Is being achieved with the Stra tegic Army Corps, the Army's "fire brigade" of three battle ready divisions that can be rushed rapidly to any area In the world. He also stressed the Army's special forces group capable of organizing guerrilla-type warfare, as of "particular im portance now." "In my opinion," he added, these special forces will be "most likely of increasing im portance in the years ahead," in the task of meeting chal lenges in the form of subver sion, insurgency and guerrilla actions. , Warning that the Commu nists have continued to im prove both their nuclear and non-nuclear power, Stahr said: "We must be prepared to deal swiftly and effective ly with military adventures directed against any part of the Free World." "If we are not so prepared," he declared, "those adven t u r e s will multiply . and spread." Supports Missile System He reiterated the Army's desire to develop its Nike Zeus antimissile system, de spite the administration deci sion to limit the program and hold off on making it an op erational system.
