Nixon today to help them salvage the fed eral school aid legislation which was wrecked by the House Rules Committee. Code Violation Brings Court Suit Donald M. Claypool and Elizabeth Anne Claypool have filed a suit against Thomaa E. Whittle, contractor, askine that the contract for purchase tween bills passed separate ly by the Senate and House. The surprise action stunned backers of the legislation. The committee's 7-5 vote saw all four Republicans loin three Southern Democrats in opposing the conference Challenges Nixon Rep. Frank Thompson Jr, (D-N.J.), author of the House bill, challenged Nixon to per. suade Republicans on the rules committee to seek re consideration and to switch votes. Thompson called the solid GOP vote against the confer ence a "repudiation of Nixon in no uncertain terms." The vice president's press secretary told newsmen last week that Nixon was working with House GOP leaders to clear the way for a conference on the school legislation, Thompson and other Demo cratic backers had counted on Rep. B. Carroll Reece (R- Tenn.) to vote for the confer ence because he had voted to clear the House bill when it was stalled in the rules com mittee earlier this year. No Immediate Comment Nixon had no immediate comment on the situation. So far, it was learned, he had not Intervened in an effort to win committee reversal. The Senate-House dispute over school legislation centers on aid for teachers' salaries and an a n 1 1 - segregation amendment. Rules Committee Chairman Howard W. Smith (D-Va.) pressed school aid supporters Wednesday for assurances that the anti-segregation amend ment would be dropped if the conference was permitted. The Claypools allege In their complaint In Jackson county circuit court that the agreement of Jan. 20, 1960, provided that the Claypools should be furnished a title in surance policy by Whittle which he has refused to do. The house the Claypools bought was in violation of the Medford building code and zoning ordinances at the time of the purchase and the house is not marketable as a result of the zoning violation. The Claypools allowed Whittle four months to correct the violation, but Whittle failed to do so. the Claypools charge further. Algeria to Send Peace Emissary Paris IBPD - The Algerian rebel leadership will send their advance peace emissary to Paris probably before the end of the week, informed Tunisian sources said today. The sources said Tunisian officials were putting heavy pressure on the rebels not to let protocol problems inter fere with the first promising chance In five and a half years to end the Algerian war.
