Society Awards Research Granls Portland -Two research grants totaling more than $100,000 have been awarded by the American Cancer So ciety to Dr. Howard S. Mason, biochemist at the University of Oregon medical school, ac cording to William B. Felden heimer, president of the so ciety's Oregon division. Dr. Mason's project is a study of free radicals and oxy gen metabolism, and the granls from the cancer society cover a 5-year period. Feldcnheimer was advised that the grants included $54, 310, to be known as the Ethel M. Craig memorial grant for cancer research, and $45,830, to be known as the C. Jack son Eldon memorial grant. He explained that Mrs. Craig of Medford and Mr. Eldon of Portland willed funds to the society for cancer research. The Craig grant will be used to expedite the project in its first year, while the Eldon grant will be spread over a five-year period, Washington-WPli - Contempt of Congress convictions of six men who refused to answer questions of congressional Red hunters were upheld Satur day by the U. Landlord Not Liable for Injury on Leased Premises Lyle, who owned a business building, leased space to Tom who operated a small retail store. The premises rented by Tom included an office which could be reached by ascending a stairway, One day Carl, one of Tom's customers, was mounting the stairway when a step collapsed. Carl fell and broke his arm. Can Carl sue Tom and Lyle? There is little doubt con cerning Carl's rights against Tom since business guests can recover from proprietors when they are injured as a result of building defects. This general rule has its ex ceptions and Lyle will be re sponsible if one of them ap plies. Must Know Defect Exists If the landlord, for example, knows that a defect exists and the tenant has no way of knowing it, the landlord Is liable for any injuries suffer ed as a result of the flaw. Therefore, if Lyle knew that the step was broken and fail ed to inform Tom, Lyle is li able to Carl. Some courts have held the landlord liable when the premises h a v e a hazardous condition and the landlord knows that the tenant will op erate a business that is open to the general public on the premises. Most courts, how ever, restrict the landlord's re sponsibility to the situation where the place will be used by large crowds such as thea ters and auditoriums. Lyle will be liable under this rule if the court follows the more liberal view. Promise in Lease Lyle will clearly be liable if the lease contains a promise by Lyle to keep the premises in good repair and he defec tively repaired the steps. Nor mally a landlord does not have to repair leased premises, but if he agrees to repair in the lease he is liable to persons injured as a result of the ex istence of structural defects created by the landlord's neg ligence. If Carl can prove that Lyle retained control over the stair way during the term of the lease he could recover from Lyle. Landlord's, however, normally only impliedly re tain control over parts of the leased premises used by all tenants (hallways, elevators, fire escapes) and the outside of buildings leased to more than one person. Since the stairway was located in that part of the building leased to Tom, Lyle would probably not be liable under this rule. Veterinarian to Report to Short . Salem - J. F. Short, director of the state department of ag riculture, has announced that he has arranged for the state veterinarian to report direct to him on a temporary basis, effective immediately. This will place the stale meat inspection and livestock disease control programs close (o the director pending com pletion of Short's general study on (he organization of the entire department. Short said during this ar rangement he will give con siderable time to direct super vision of the programs to be carried on under a Veterinary Services section. The division of animal in duslry, under which the veter inary service has functioned, will continue to administer brand inspection, brand re cording, livestock theft pre vention and related programs. Short added that he has ask ed the livestock industry to appoint an advisory commit tee to the department to main lain close contacts with the state veterinary service and to advise the director on any regulations affecting disease control or meat inspection. Harris of Medford High school is one of 54 high school students from 11 states selected to par ticipate this summer at Ore gon State college in a seven- week institute for mathemat ically-gifted students. His home address Is 720 Whitman place. The Institute Is sponsored by National Science Founda tion. Most of the 54 students selected are high school Jun iors. Sixteen are girls. The June 27 to Aug. 12 in stitute is designed to give the especially able mathematics students an insight Into the tremendous new fields of mathematics and its appllca- tion In science, engineering and Industry. It Is one of the first such programs offered in the country. Dr. Robert E. Gaskell, pro fessor of mnthemati", will be Institute director. Students were picked on the basis of their high school scholastic records and recom mendations from teachers and principals. Each will receive a study grant covering part of expenses.
