It was the only Saturday game in the circuit and broke a three-way deadlock by put ting the Pirates a half game in front of Eagle Point and Glendale. Phoenix boomed off to an IS to 8 first quarter spread with Tom Atchison collecting 14 of the Pirates markers. ine Pirates capitalized on a St. Mary's Tops Eagle Quint 50-46 St. Mary's high of Medford broke a 45-all deadlock in the fourth quarter to defeat Ea gle Point's basketball quintet 50 to 46 here Saturday eve ning. Bob Evans and Jim Cal houn put in field buckets and Dick Evans a free heave for the .Crusaders in the waning minutes. Eagle Point caught up at 43-all in the fourth panel af ter intermission leads held by St. Mary's at 13 to 10, 23 to 20 and 39 to 35. SM outshot EP 22 to 11 from the field but the Eagles had the edge 24 to 6 from the free line. St. Mary s junior varsity won the prelim 48 to 40 with Dan Laubacker making 15 points. They had 23-point differences in the late fourth stanza. Atchison had 24 points for the game and Jim Floyd 20 for the Pirates. Jerry Kite's 13 was high for Rogue River. Phoenix had 27 field bas kets to 16 by the Chieftains but RR led in gifters 16 to 12. The game concluded Rogue River's league season. It fail ed to win in six games. Pelican chances for one of two District 6 spots in the state A-l hoop tourney were bolstered by the combination of the KF triumph and Med ford's win by 77 to 53 over Grants Pass. Klamath now has a four-game margin over GP and Crater which tied for third. Each of the three clubs has five remaining conference games. The Pels on Saturday had quarter advantages of 14 to 4, 37 to 13 and 57 to 29. KF fired at a .413 field goal clip while Ashland was hitting just .238. Ashland went scoreless for five minutes in the fourth quarter. In the last minute of play each team put in five points. The Grizzlies' Bob Har dy was high point man of the game with 16. Mayor Terry Schrunk re cently issued an order against public mass demonstrations in connection with the current newspaper strike. Nine of the 11 bailed out under $250 each while juve nile authorities said they would hold two 17-year-olds until today. The group, which number ed 25 at one time, paraded in front and around the building singing songs. Police said some complied when asked to leave. Officers said union members picketing the Ore gonian building also asked them to leave. Police said most of the group was college students, predominately from Reed col lege. Frantisek Tikal, a de fenseman on the Czech team, met brother Zdanek, who emi grated 12 years ago and is now playing forward for Australia. NET CHAMP Palm Desert, Calif. - (UPD -Jon Cranston, outstanding Southern California young tennis amateur, won the sin gles championship Sunday of the Palm Desert Invitational Tennis tournament with a comeback 2-6, 16-14, 6-3 vic tory over favored Larry Nag-ler. What Is The Law? This column is prepared as a public service by the College of Law. Willamette University, Salem, to explain basic legal principles, not lo provide legal advice. The reader is cautioned not to apply these cases to his own problems without an attorney's advice, for differing facts may change the outcome. Is an innkeeper responsible for a bottle thrown from his window? Back in 1949 the captain of a ship rented a hotel room in Hoboken, N. J., for himself and five sailors. They all ar rived early in the evening and apparently started having a party; they called the clerk to inquire about a bottle of rum. It was not supplied to them by the hotel. At about 10 o'clock another guest of the hotel called the clerk and told him that the sailors were making a dis turbance. The clerk cautioned the sailors, and they assured him they would be quiet. A half-hour later, the guest com plained again, that the sailors were tossing something about that sounded like a shoe. The clerk then wentto the room and told them to be quiet or they would be "ejected from the premises." Serious Injury Caused About midnight a couple was walking by the hotel when a soda bottle was thrown from the hotel by one of the sailors. It hit the pave ment close to the couple and a fragment of the glass en tered the lady's eye causing a serious injury. The injured lady sued the hotel for the damages she had incurred. The trial judge directed a verdict for the hotel because he felt that the hotel was not expected to con trol the conduct of its guests. The state supreme court, how-, ever, felt that there was a good chance that the hotel could have done more than it did to control these guests; they reversed the trial court and sent the case back for a new trial. There is a sizeable number of cases of this type and most of them hold that the inn keeper is liable to a stranger if the innkeeper, as a reason able man, knew or should have known of the need to control the guest and had an opportunity to control him. In the New Jersey case, the hotel clerk had noticed that a rather wild party was in progress in the room and probably should have done something about it. Outcome Changed Circumstances, however, changed the outcome of a similar case. On V-J day, when everyone was celebrat ing the end of World War II, someone threw a heavy over stuffed arm chair out of the window of the St. Francis Hotel in San Francisco. The court pointed out that the hotel did not know where the chair came from and under the circumstances that prevailed on V-J Day, could not be expected to con trol guests of the hotel. The California court said, "To keep guests and visitors from throwing furniture out win dows would require a guard to be placed in every room in the hotel."
