WHEREAS, the City Coun cil heretofore by Ordinance No. 7178 declared its inten tion to construct a sanitary sewer system in the area de scribed above as the Berry dale Sewer Area; all to serve and benefit real property ly ing within an area there in described and referred to as the Berrydale Sewer Area in the City of Medford, Oregon; and to assess the cost thereof upon each lot or parcel of adjacent to and benefited by said sewer its proportionate share of the cost of said im provement, and fixed the time and place for hearing protests against the construction of said sewer and the assessment of the cost thereof as afore said, and notice of said hear ing was duly given by pub lication and posting of said ordinance for the time and in the manner prescribed by the City Council and the Charter of said City; and WHEREAS, a meeting of the City Council was held at the tune and and place fixed in said ordinance for the pur pose of considering any such protests, and after hearing ail protests made, at said time and place to the construction of said improvement of tne assessing of the cost thereof as aforesaid, the Council con sidered the matter and, by Ordinance No. 7182, deter mined that the construction of said improvement would be of material befenfit to the Citv and of special benefit to property situated within the said Berrydale bewer Area, and ordered that the said sew er be thus constructed and the costs thereof assessed as - i i xrl Trfoertv descriDeo m vui Sme 268, Page 221, of the peed Records of Jackson the said im- Drovement has been complet ed and the total cost thereof has been, and is hereby, de termined to be the sum oi $301,307.19 and that all the real property within said Berrydale Sewer Area and described in Section 4 of this ordinance is adjacaent to and benefited by said sewer to the extent of the propor tion of cost assessed to each parcel thereof; and WHEREAS, by virtue of the construction of said sew er system, that portions of properties abutting Maniee Street, outside the district de scribed herein but inside the City Limits, shall be unassess ed and collected by way of a connection charge, at the rate of $2.85 per front foot, $74.26 per lot, and $72.34 tor home connection being a tot al amount of $1,195.65; and WHEREAS, the City Coun cil has authorized that an amount of $29,000.00 be paid from the Sanitary Sewer Con struction Funds; now there fore, THE CITY OF MEDFORD DOTH ORDAIN AS FOL LOWS: SECTION 1. From said tot al cost, there is hereby re served from assessment, the sum of $1,195.65 being the amount to be recovered by connecting charges to be charged for connection of properties on Marilee Street; and SECTION 3. From said tot al cost, there is hereby re served from assessment, pur suant to authorization of the City Council as the amount to be paid from the Sanitary Sewer Construction Fund, the total sum of S29.000.00; and SECTION 4. The remaining portion of said total cost of the Sanitary Sewer System, to-wit; the sum of $271,111.54, shall be assessed as herein after provided. It is hereby determined that the propor tionate share of the cost of construction of said improve ment on each parcel of prop erty adjacent to said improve ment andor benefited there by is the amount set opposite the description of each piece or parcel -of land below, and that each piece or parcel of land is benefited by the con struction of said improve ment to the full extent of the amount set opposite such piece or parcel and that the respective amounts represent the proportional benefits of said improvement to the said respective parcels of proper ty, and the City Council does hereby declare that each of the parcels of property de scribed below is hereby assess ed the amount set opposite each respective description for the cost of the construc tion of the said improvement.
